In-State College Tuition Can I get it now?

So unfortunately, I am not going to graduate this semester too, I have two more classes that I need to take.

And since they are major classes, not offered in the summer. So I will be going to School in the next fall.

so the question is will I be eligible for in-state tuition in the fall 2011 semester?

I think this is up to the individual school. You might want to check what their requirements are for in-state tuition. A lot of schools do offer in-state tuition if AOS is pending. Double check though

Here's my experience as a former F-1 myself.

I decided to take one class at a local community college in California last fall. Alas due to pending AOS they said I need a green card in order to be considered for instate tuition. My argument that I have been living in California for more then the last 10 years, prior as an F-1 but now out of status did not change anything.

I dropped the class and went back early February this year with my green card in order to have the classification to be changed to California resident. But what a bummer, the college then told me that due to state and federal laws I would need to be a permanent resident for at least one year before I can pay the lesser tuition fees.

I tried a different community college district to see if they would accept my LPR status but again, ran into the same problem.

So it really depends on the state and how much the schools enforce the policies. Be aware you may not be able to attend school at a lower tuition until over a year from now since you even haven't received your green card. It sure sux, as who doesn't want to pay $27 per unit compared to over $100.

Here in florida since my wife has been living here for all her life I was able to qualify as instate tuition check again and show them proof of marriage,citizenship of her you do need a state DL and things that show that both of you are marriage and been living in the state,talk to a supervisor they will help you more if they don't do it go to the DEAN and be a pain in their butt hope this help

4/23/11 received Biometrics appt for 5/11

4/28/11 successful walk in Biometrics

5/13/11 EAD arrive

5/16/11 APPLY FOR SSN

5/19/11 GOT MY FL DL WIFE IS SUPER HAPPY SHE DOESNT HAVE TO DRIVE ANYMORE.

varies widely by state. ask the school itself, they will provide the specific answer you need...

Timeline

Most schools have requirement of you living in the state for sometime after you getting a LPR.

The day you get your LPR does not give you benefit of in-state student, you have to wait for certain time based on school to school.

We had a similar problem with my step-daughter. She was going to be two weeks short of the required 1 year of LPR status on the day the semester started. The college had a form you could use to petition the board for a waiver and recognition as a resident. We filed the waiver request, along with evidence of when she entered the US with a K2 visa, a copy of the NOA1 for her AOS, and other immigration related stuff dated well before the 1 year window began. They accepted the petition, and allowed her to enroll with in-state tuition.

It wouldn't hurt to go to the admissions office and see if the school has a similar petition process.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Wow, you were lucky here - I had my 3 year old driver license on me when I went to the office and showed that as supposedly California law only gives driver's licenses to those who are lawfully present in the US, also had utility bills in my name from over 5 years back for the regional electricity provider , marriage certificate....but as I mentioned before, doesn't change a thing of not being an LPR for a year....thought I add that to my experience since you mentioned what you would/did bring for your case ....

how does my wife say "if it's not easy, you have a ton of obstacles, throwbacks, maybe its not ment to be at the time"

ok hoping that my school isn't one of those who require you to be a LPR for a year before you can benefit from an in-state tuition

it says on the 2nd page:

if you do not qualify under the rules described above, you still may qualify for in-state tuition if you have resided in New York State for at least one year, and one of the following applies:

the one that applies to me says

-- you are a US citizen, permanent resident, or have a permanent resident application pending (you must have filed Form I-485 application to Register permanent residence or adjust status, It is not sufficient to have solely a pending or approved I-130 petition for Alien Relative or I-140 immigrant petition for alien worker.

you need to stop watching Jerry Springer and pay attention to politics once in a while. California law explicitly prohibits any state-operated institution of higher education to inquire about a student's or prospective student's immigration or citizenship status. They just can't do it and if they do, they are violating state law.

As someone who studied with an expired B2, first at a California community college, then at UCLA from where I graduated with a B.A., let me tell you that the requirement for California in-state tuition can be met by showing a California driver license that is (a) still valid and (b) has been issued at least a year ago. Now try to figure out how illegal aliens are able to attend college in the Golden State if they do not have a Green Card or a California driver license? Exactly!

If somebody gives you #######, you need to be able to call 'em out on it.

It also varies within the state.. another member said in FL they did not require 1 year residency, but My wife is required to show proof of one year residency to be eligible for in state tuition..

Man, did you have to go there? Comparing my posting with someone who's a Jerry Springer watcher? I mean come on, this forum here is for people to share their knowledge, thoughts and experiences and so did I - by posting what I went through in reference to the OP's question.

Maybe you even can be of help here by actually posting a reference of the law that applies. I barely watch TV, have no cable TV and get my news from various public radio stations as well as different reliable, established and non-biased internet news pages. In the recent years I have only heard something about California law re: in-state tuition that proof of being enrolled in high school in California prior to going to college is something you can use qualify.

So again, do people a favor and post a link, and even better to include the official California code, where you read and obtained your knowledge about the "don't ask don't tell your immigration status with admissions and records offices". With that in hand I definitely will go back to the vice chancellor of education office and make my case again and point out that they as well as 3 other community college districts in my area are doing something unlawful by asking when you enroll for the first time - thanks.

p.s. a thought - so they are only allowed to charge out of state tuition to people from a different state that transfer to a Cali college as they do need their transcripts or high school diploma when applying?

States and institutions vary. The local junior college here in California doesn't care what your status is, but they want to see utility bills proving you have been living in the state for the last year in order to pay instate tuition.

...saw your posting and in your profile on the side that you are from SF - which school are you talking about? maybe if you don't want to disclose in a posting, maybe send me a private message? I have tried "a" college in SF as well as 2 districts here in the East Bay without success - as mentioned in my previous posts.... curious now :)
