How do you file for Divorce overseas???

I have had all I can take now.. with this whole process. Long story and no need to go into it. I can't file my taxes, cause he doesn't have a SS# or a ITIN#, and I also want to file for Divorce. I need to know.. I don't want to have to deal with an attorney until I get some facts, that way this whole thing doesn't cost me more money for attorney fees. Please let me know if anyone has some insight.

You can file taxes by yourself, you would do this by choosing the "married filing separately" filing status on Form 1040.

About the divorce question - you would have to find out if the US would recognize a divorce in the country your currently in. Here is some info the US Army put out.

Recognition of your divorce "back home" (in the U.S.) may be a problem if you get your divorce overseas. American courts are required by the U.S. Constitution to recognize and honor the orders and decree of their sister states (so Kentucky, for example, would have to honor and enforce your divorce decree from Arizona). But U.S. courts do not have to recognize court decrees from other countries. Your divorce decree and child support order from Belgium, for example, may not be honored in Florida.

The "feel" I get from searches suggest it would be easier to get it in the US.

Having a child will also complicate the matter. (child support)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

1st Sorry to hear that

2) You dont have to file Marry as he is not in the states . You can amend later if you want . This will not create any more problems to your immigration process.

3) If you still want to go for the D word and there is no Chidren or Assets you can File really eassy

4) A couple of years ago there was a new law that has to do w. No physical Contact for more that 6 months i dont remember the name however that was my route on my Divorce .

5) As a simple Divorce .Remember we are talking US LAW . You dont even need his signature , I shouldn cost you more that 500 dollars . Plus court fees could run another 400 .

6) A consultation fee on a LAW office should be free and if you find a really good Lawyer he may do the documents for a really small fee . Your Husband or wife dont have to agree .

Know the trick is Time

Counting in No assets or Kids the process should be painless and quick however some FAM courts are like the NVC and USCIS always runing Begind .

My experience was harded because i did had a House and a KID and i want it to keep the KId wish i DID .

GOOD LUCK AND REMEMBER the TAX info i have FAM that work on the IRS and you wont be braking any LAW by Filing single .. DO your taxes finish that stage . IF you cant get the INTN # is not a BIG deal even as you are Marry the and marrige to a forener is recognaze as legit in the US At the end of the day and for the IRS dep the Person does not exist i extrange however is one of does grey areas on the LAWs of our system .

NOW that been said if yoiu continue your Immigration process you should ammend your taxes as the person get recognise in the US ( SS# or INTIN # )

Pepole can get ansy about the tax process due to our circunstances and at the end is so simple

1) Person dont have SS#

2) Too late to get the INTIN#

3) FIle Single

4) Ammend as soon as you get any of the 1 or 2 Numbers

5) DONE

I think you can concurrently file the request for the ITN and the tax return. No sense in not getting benefit of tax deduction. His overseas income might not be taxed.

If OP opts to get the ITN Form W7 needs to be completed along with an Embassy Notarized copy of the the passport page of the husband/Wife it is also highly recommended to also have the power of attorney and Declaration of Representative Form # 2848 be completed signed by the spouse so one can communicate with the IRS. The IRS has denied issuing an ITN for my wife twice, the second denial was just because the form was not clearly marked as a copy despite on every page of the tax papers it said COPY. If it is an original, then both need to sign and submit. I opted not to submit a third time and will re-file my papers with the SSN number one it arrives by mail after her entry to the US in July instead of having to do this all over and then be stuck in getting the IRS from changing her ITN to an SSN (which takes a long time to happen)

I have a similar problem, came from the UK on a k1 visa, got married on the 10.23.2010 in IL. but now had to realize that our marriage was not of two equal partners but more like master and slave. my wife decided to inform me on my last day of being legally in the US that she will not sign the removal of condition application. Therefore i had no choice but to leave the US on may own ( not being deported ) and now need to look for a divorce while i am back in the UK as my wife wants to prolong the the divorce. I her own words she keeps anything what she is entitled to, even my personal jewelry. I now feel like i have been rolled over, but i just want a divorce as i feel like everything else is only material.

Can anyone give my some advice how to proceed, PLEASE.
