HI,

Any helpful response would be useful. :thumbs:

My wife, who is from Japan, and I are now at the stage if the visa process where we have to submit the Affidavit of Support the appropriate fees for it. My question is I am unsure of which I-864 I need to do. I am aware of the page indicating which Affidavit the petitioner has to fill out if the circumstances fulfill what my spouse is under. This Affidavit is just for my spouse.

The Options are:

The applicant you are sponsoring has earned or can be credited with at least 40 eligible quarters under the Social Security Act (SSA)

You are sponsoring a child who will become a U.S. citizen immediately upon entry under the Child Citizenship Act of 2000 (CCA)

You are a self-petitioning widow(er)

You are a self-petitioning battered spouse or child

All three of the following are true:

You filed a Form I-130 petition, for your relative

The there is only one applicant on the Form I-130 petition, and

All your qualifying income comes from a salary or pension and shows on one or more W-2 Forms that you receive

If none of the above apply

I think I have to fill out the the second to last one. Please verify for me which one needs to be filled out. Thank You.

all you have to do is fill out the I 864 EZ if you are the only sponsor.. and since your wife is from Japan you are sponsoring her your self.. she has not working in the us so doesn't qualify for the question about qualifying quarters,unless she has been here on a work visa.. and on the I 864 ex or standard.. if it out as per to your income. there is an example form here on visa journey on how it should look like... good luck

Thank you very much but...one of the requirements is that

c) All your qualifying income comes from a salary or pension and shows on one or more W-2 Forms that you receive.

Here are the three requirements you must fulfill if you can fill out form I-864 EZ. I worked in Japan for 3 yrs. and paid Japanese taxes. Upon arriving back at home in the U.S. I only worked two part-time jobs; one for a month during season work, and the other I just started in early April. I'm currently in the final stages of the application process for a job with the government but at this time I don't have a W-2 to base off my income. What should I do? If my parents were to be the sponsor what form would that be, or do I still apply for the I-864EZ?

Here is the criteria for the I-864EZ.

All three of the following are true:

You filed a Form I-130 petition, for your relative

The there is only one applicant on the Form I-130 petition, and

All your qualifying income comes from a salary or pension and shows on one or more W-2 Forms that you receive

From what you describe it sounds like you will need to use a co-sponsor (your parents) as your US based income does not meet the minimum income requirements. It sucks, but immigration does require you to have US sourced income. Your parents would fill out the I-864 and provide all of the documentation requested to verify income requirements and you would also fill out the I-864.

I'm going to move your post from the Canada Regional Forum to the CR-1/IR-1 forum as this is the visa you and your wife are pursuing and there will be other members there who can give you more specific details on how to use a co-sponsor.

Hello everyone,

Another question that seems a little confusing :wacko: due to the circumstances but for my joint sponsor, who happens to be my parents decided to joint sponsor my wife both I and them each fill out I-864 or do they fill out I-864 and I fill out I-864a? :help:

There is one more part to my question. :ot: I worked in Japan for 3 years and during that time I paid taxes in Japan. I do not have any W-2 forms for the recent tax years since I was living in Japan. :ot2: If I was to fill out I-864a I would have to state this under number 11 and write a note explaining so, correct? For I864 Part1. would I just state I am the petitioner, which I am, or the second of two joint sponsors, the second being my parents?
