Then the problem is, if you knew about the marriage, and the failure to end the marriage, you should have pulled the petition because you knew you were inelligible. That will be the issue for USCIS in the future

hey @life's journey 1st of all www is world wide web not whole wide world and 2nd thing it is very easy and cheap to make fun of others problems..so you r not doing anything special here but helping others is a difficult job so saying cheap things instead of helping is really very easy.

I know the first instinct is to explain your/his actions, but every time you post an explanation you open a bigger can of worms, so I would stop trying to explain and concentrate on fixing this big problem.

The first problem is not even immigration related, it's that you are pregnant and not legally married in either country.

The second problem is you maybe to far along in your pregnancy to travel to try to fix your in-valid marriage situation before the birth of your child's birth.

Third, he lied to you and didn't care about the consequences until it was too far gone.

You need to be aware that everything that is posted is read on the wide world inter net. I have never posted anything that is cheap to you, I have been very professional in my posting, you needs to be careful of what you are posting. Again if you only want others to agree with you then just ask for those of wants to agree with you to post.

A big thanks to @canadian_wife...i will talk to him and if u know other good attorneys who deals with refusal and hav gud records plz let me know coz i want to hire the best lawyer bucks doesn't matter at all

And for knowledge of others i will do everything to get my husband here...

so, whilst you did not know about the prior marriage , prior to marrying him -

you DID know about it prior to filing the I-130. yikes.

IMO, that would lead to a material misreprentation (on your part) , later, when things are sorted.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

You can't get your "husband" here because you are NOT legally married. You are trying to get your fiance here, your bf, your baby-daddy, but NOT your husband. It's important that you know that.

It's also important that if you filed taxes as married that you amend your tax return to single. You'll also need to change your last name back on your SSN, drivers licence and everything because your marriage is NOT valid and thus your marriage certificate is fake and so is your new last name (if you changed those things). Any time you declared yourself as married (like for work or anything else) you'll need to amend that back to single. It's one heck of a mess that you need to clean up.

Appeal will not work, you are not married.

Your only choice will be to wait for his divorce, marry him after that, then file again. Bearing in mind he's now got a material misrepresentation to overcome and it's likely he won't (he knew he was married and knew he wasn't divorced and didn't declare it) and that carries a lifetime ban. You need a VERY good lawyer if he stands a chance... but it won't be for several years. I'm sorry, he shouldn't have put you in this position and you should have withdrawn the petition as soon as you found out and you wouldn't have had these issues.

No she knew 10 days after filing the K3 she said. Either way she knew before the petition was approved, knew before the interview, and knows now. I think she's in deep poop as well!

Yep I agree. Had she done that (which I know at least one other person did when she found out her divorce wasn't final yet and that that was bad) then she wouldn't have had half as many issues... It would still be on file that he said he wasn't married before, or that he was divorced when he wasn't (however they explained it) but it wouldn't have been as bad at all I would think.... though in reality it would still be bad I find it interesting that she doesn't seem the least annoyed that he lied to her for their ENTIRE relationship about not being married, went through a ceremony KNOWING he wasn't legally able, and got her pregnant while he was married to someone else. That's a HUGE HUGE HUGE trust issue and I can't honestly say I would have forgiven my "baby-daddy" when I found out. I would doubt everything else he ever told me. Also given she admits the previous relationship was immigration fraud I would think "he claim this one isn't but who knows for sure!"
