Why don't u want to tell us the age difference between the 2 of u? This could have helped us to give a technical answer to ur questions. But until you mention your age differences, nobody could give u a reasonable answer. Don't be shy at your age. Consular may still denied the visa even when you get married for the same age difference.. So let's knw your actual age to enable us advice you better.

The reason why you're being denied is that, the petitioner's daughter is 33yrs old and is 6yrs older than the beneficiary who is suppose to be the (step-dad). So the CO assumes that how could a step-dad be younger than the petitioner's child?

This is a huge red flag and no sane CO would have approved the visa, even when they get married. That's why the CO advised him to marry from his country.

If beneficiary is 27, then i assume the petitioner is 53 as her daughter is 33.

The CO sees this as just an immigrating tendency for the beneficiary because the CO assumes that petitioner may not be of child bearing age again.

"AGE DIFFERENCE" at Cairo Embassy must not be too much of a problem since I'm 18 years older than my fiance and we were approved. I think that there's other issues when someone is denied. I have read alot on VJ thats talks about age difference and it made me so upset thinking we would be denied for that. Most times in alot of the post it always ends up being something else other than age. The best thing ppl can do is make sure they have evidence of their relationship, call logs, letters, receipts, photo's , emails, letters from family members saying they agree to your relationship. Anything that will show you have a real relationship. And If your income isn't enough make sure you have a co sponsor. And present yourself well at the interview, this is very important also. When you love someone you love them no matter how old they are, being it's of legal age of course..The best to the OP

Age difference is never the sole reason for a denial. It's a red flag that prompts additional scrutiny of the bona fides. The most important thing people can do is make sure the actually have and conduct a bona fide ongoing relationship for the right reasons and THEN document the relationship and be well prepared for the interview.

KEY is actually having a bona fide relationship and there is NOTHING one person can do to assure that. It takes TWO. The kicker is one person has no control over the other. Most denials in fraud cases are big surprises to the one being deceived.

Just a side note, DCF has been suspended in Egypt until further notice. You'll have to come here, get married, go back to the US and file from there.

I'm Egyptian and my wife is American. We have been married for almost 4 years. We are living in Egypt and we had to deal with the embassy a lot. Since before our wedding(during which we had to battle them vigorously) till the birth of our baby girl, we've been to the embassy several times and we saw different couples trying to get married. In addition to that, we have been known to embassy staff during the revolution when the embassy closed down and we had to get a passport for our newborn baby girl. During that time, a CO at the embassy said that the most common profile they have for marriage cases is a younger man meeting an older woman online. So let me assure you that age does matter. From what I read about your situation, it perfectly fits their profile. You met online, you don't know each other very well(3 short visits don't count) and the age difference.

As an Egyptian, I totally understand why the CO said what he said to your fiance. It's almost unheard of to have a man of any age who hasn't been married before to marry a woman who won't give him children and assume that his parents are OK with it. However, I take your word that your fiance is a good man. Having that said, let me tell you what is the stereo type of a situation like that in the context of my culture. A younger man going after an older woman would end up having another wife at a later stage in life and have the children he wants and the laws allow that here in Egypt. He would get his parents blessings by telling them that(Not all parents would go along with that but few would). The cultural pressure in that regard is so huge, you cannot and you should not discard it. I believe the CO had that in mind except the part of having another wife since the laws don't allow it in the US.

Great post but OF COURSE US laws allow that younger husband to have another wife. It's called divorce and remarriage. That's the actual plan in these fraud cases. Once the older woman has been used to obtain legal status in the USA, she is divorced and the man remarries.

Incorrect, DCF hasn't been suspended in Egypt until further notice, it's not an option in Egypt at all. This is because there is no USCIS field in Egypt.

You'll have to come here, get married, go back to the US and file from there.

Also incorrect, an I-130 petition can be sent from an overseas location (including Egypt) to the lockbox facility in Chicago.

I don't know what you are talking about. My wife filed I-130 at the Embassy in Cairo last April. This is called DCF. They are not processing any more of those till further notice. A friend of ours called them up and they told her that plus the website page that has the information about it has been removed.

My fiancee had an interview today at the US Embassy in Cairo visa denied due to our age difference....Did anybody have the same problems because of age difference they have to deny his visa? They told him to marry a woman in Egypt. Why do they have to question him like this. This is not the interviewer business to ask him just because of our age difference. What is the next step I could do if his visa is denied? He answered everything right, paperwork is all correct but WHY the interviewer do this to him. :(:help:

Sorry, but, the embassy has to side of caution, as there are many many sham marriages which take place. I would also advise getting married in Egypt, as it would legitimize your marriage and provide a better case for spousal visa.

If you don't want to go that path,maybe hire a lawyer in the US, and seek some advice.

I am talking about this announcement that was made last May after your wife had filed the petition at the Embassy in Cairo (I know what DCF is called by the way :whistle:). That announcement specifically states that effective August 15, 2011, if there is no USCIS field office in the country, the I-130 petition will have to be sent to the Chicago lockbox. That announcement supersedes anything your friend might have been told about "suspended until further notice" (a term that implies it would be available again in the not too distant future, it would have been more proper to say DCF is not an available option). Furthermore, the website page that had that information was removed because of the announcement I linked to and Egypt is not on this list of USCIS International Offices.

Ryan, thanks a lot for making it clear. I mentioned the DCF to be sure we are talking about the same thing. I'm not an expert in that whole process. The good thing about DCF is that it saves 6 months so I'm glad we made it before they changed it. I hope that change won't make the process longer for newer applicants.

If you have that in writing as the stated reason the consulate has a lot of trouble on their hands.

You don't and you won't.

The fastest easiest and cheapest way to approach a denied K-1 is to start over with a new petition and prepare documentation better next time
