Forgive me for asking but previous answers were not definitive concerning if approval of biological father needed for child K-2 to leave country. here is situation. Fiancee recently received annullment in April 2011 after separation of 9 years. Father of her 2 children has not been in picture i.e. no child support, no visits, no phone calls, etc for many years >8. What document or form from what agency is required for her to leave the country with the 2 children following receiving K1 visa?

Court documents stating she has sole custody of the children and can move them out of the country if she so wishes.

The PI is very different, the standard answer does not apply.

The PI is very different, the standard answer does not apply.

The difference is if the child was born out of wedlock.

In this situation the Annulment should specify if the mother has sole legal custody or not. If she does then that document is what's needed. If not then she will need written consent from the biological father.
