I filed an I-130 for my husband in Aug 2010 and as of this month it will be 9 months and I have not received an I-130 approval. This is over the normal processing time and I have contacted USCIS and all I was told was to wait for 30 days to receive an answer from them.

i don't know what to do. Should I wait the 30 days? Would I even receive an answer from USCIS? Should I call the USCIS headquarters instead? SO confused!! I have waited 9 months and haven't received an approval yet, this is ridiculous.

need advice

thank you

Woa... Thats a long time. I would contact the headquarters

I called the general USCIS number today and they weren't much help. I was told that they sent in a request and I will be hearing something within the net 30 days and if not I should call back. I feel this would make me run around in circles. Should I just go ahead and call the headquarters anyways? What should I tell them? I hope I won't be told to wait out the 30 days for an answer.

2 months ago before my i-130 was approved, i talked to one of the customer service in USCIS California & was told that waiting time for i-130 for permanent residents are from 6 - 12 months.. i hope your's won't take that long unsure.gif

Good Luck!!!

Really? That's so odd that when you check for I -130 processing times for the different processing centers via the USCIS website it says 5 or 6 months or something and they told you 6-12 months. Hmm. How long did it take for yours to be approved? The thing is when I check my case status on teh USCIS website it says it was last updated in Oct 2010. That was a long time ago and I fear something is wrong.

Thank you for responding though

This is quite frustrating as it is with the retrogression and the ridiculously long waiting time for LPR spouses to get a visa that long delays make me nervous. :/

to 12 months.. and you took that for an answer? lol - not kool. the average processing is 5-6 months unless background checks hold it up. you can look over the recent approvals for april/may in the preference category.

Mine was approved 1 week after I became a US Citizen. You've got to take it to the next step which is to contact your local Senator. I know & I can feel your frustration. sad.gif

Again, Good Luck to you!!!

Mine was approved 1 week after I became a US Citizen because I was informed that I must call them if my citizenship changes, call them to upgrade the petition which I did.

I filed the petition January 6, 2011 & was approved April 26, 2011 -- 3 months & 20 days

You've got to take it to the next step which is to contact your local Senator for help. I know & I can feel your frustration. sad.gif

Again, Good Luck to you!!!
