Before I would be able to give any advice, I'd need to know what's inside the O.P's passport in regard to visa and I-94(W), and I'd also need to know what forms have been filed in her behalf so far.

Have to apologize for giving poor advice. So screwed up this case, I will never be normal again. Thought the young lady was stuck in the UK, apparently she is here in the USA. Still not sure about the status of her mother, or how they came here in the first place. Or where her baby was born. Now I am under the impression she is here as an undocumented person, if so, that is even more problems for her.

Bob is using the correct approach, ask questions first, give advice later.

For anyone to give you good advice, they need to know the specifics of your circumstances. You have been very vague in your descriptions but doing so precludes you from getting the advice you need.

How did you enter the US? Did you have a visa or did you use visa waiver?

You said you filed "for extension on your passport" but your passport has nothing to do with any US agency. An extension would be filed with a UK authority (assuming that's where you are from). Or do you mean that you tried to extend the period of time you were permitted to stay (e.g., you had a 90 day visa and tried to extend it another 90 days).

If you or your mother contacted US immigration about your status, what exactly did you send in? Did you just write a letter or did you file a form? Since you were contacted for more information, I assume you received a notice with a file number - have you tried to find out what happened to that file?

Is you future husband in the military?

Was your child born in the US?

It is good that you are trying to find answers to exactly what you need to do because you are talking about you and your children's future. There are a lot of knowledgeable people here that can provide good advice, but only advice none the less. I am assuming you do not exactly know what your current status is because you did not mention having a green card in your possession and you are not exactly sure what your mom sent in 5 years ago on your behalf. Having said that, I strongly recommend you consult with an immigration lawyer. If you can find one who is also very familiar with representing military spouses, that would be ideal. Just my two cents and good luck!:)

My mother and brother moved to America in the middle of the year 05, I was meant to come for a vacation over Christmas that year. Without getting to much into detail, some stuff went down back home and I wasnt able to return. Papers stating that I wished to stay in this country were sent in, along with the money needed and information about myself. We havent heard anything and its been almost 6 years. Im getting married in a couple of months, also I have a 3 year old and another on the way. Im hoping to apply for adjustment of status towards the end of the year. Does anyone have any advice on how to go about this? What exactly I need & need to do? Much appreciated.

Yep – I agree that just statement that right paper work was sent 5 years back and there is no response is not enough information to give you right advice.

You will have to provide what form did you fill 5 years back, what stamp is stamped in your passport etc. Most of the USCIS forms have form number and if you can provide which form number you filled out would help VJ members to give you right advice.

This thread honestly contains some of the worst advice that I have read in a long time.

To the OP : You can file for adjustment of status once you and your fiancee are married. At this point you are not able to adjust. If your mother filed for you years ago, you need to find out what happened with that application. You were 14 when you entered the US so you should be able to remember what happened when you entered. Did you ever go to the US embassy in the UK in order to get a visa or did you just enter the US after seeing someone at the Port of entry?

The reason why I ask about the application is because if your mother did file for you and you didnt turn up for the interview or your mother didnt send in relevant information; your case may have been denied. If it was then you may have had a notice of removal and you wont even know about it. Maybe you moved or what have you but you need to find out what happened to that initial application before you make a move on a new one.

The reason I say this is because if you entered on the Visa Waiver Program, you will not be able to appeal a decision that was made. If a decision was made and you didnt know about it, this could be problematic for you because it means you would have a problem adjusting your status.

Im not trying to scare you but I want you to understand where you are at this point. The government may well and know who you are but when you offer yourself forward to adjust status you open yourself up to their discretionary powers of approval or denial.
