Hi everyone!!!

I just recieved on my email a RFE, and it said.

*Submit all suppoting tax documentation (W-2s. 1099s, and all the supporting tax schedules)Submitted to the internal revenew service ( IRS) from the petitioner/sponsor on Form I-864, Affidavit of Support, for the most recent tax year"

* The join sponsor on form I- 864, Affidavit of support, must be a United States Citizen.

"Submit evidence of the joint sponsor's status".

My first question is what should do we include in our response. Should be enough send the transcrips from the most recently year from my husband (petitioner) and my Mother in law ( Cosponsor). and send my mother in law's Birthday certificate. to provide her status.

Transcrips replace W-2s. 1099s, and all the supporting tax schedules?

My second question is. we sent the form I 864 filled by the petitioner and other filled by my mother in law( cosponsor). Also we sent the Form I 864A, filled and signed by my husband and my mother in law. we live with my mother in law in the same house. she is divorcee and doesnt have any children under 18 year old. it is correct or are we missing some forms.

Did you previously send the tax transcripts? If so then I would send the actual copies of the tax returns since they are specifically asking for that. As for the Status of your co-sponsor, Send a notarized copy of their passport bio page or birth certificate or both. Either are proof of citizenship.

we just sent the transcripts alone, but i sent copies and didn't get an RFE.

it was via an email? wow - usually 'what we want' solely comes in via postal mail.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Yes, transcripts for three years from sponsor and co-sponsor is good. You also need to prove the sponsor and co-sponsors status as a US citizen, like someone previously stated, copy of passport info page will do. Good Luck!

Yes, you can use the transcripts in place of the 1040, W-2s and 1099s. IRS transcript = 1040 + W-2s + 1099s. They are easy to get from the IRS for both your husband and your mother-in-law. You can order them over the phone using the automated system. They take about 7-10 days to get in the mail. I've heard they can fax them to you immediately but you have to have access to a fax machine to receive them right away.

And, she can use a copy of her US birth certificate or US passport data page to prove citizenship. Whichever is easiest.

Now we are very clear what will we send!! And i know why they are asking for my mother in law status because she was born in germany while her parents were on navy :bonk: ..

So we will send her Birth certificate.
