Hi,

I have a question im unemployed currently enrolled in medi-cal program. does it affect my petition? the reason why im not working now becuz im taking care of my toddler who's super hyper & i know child daycare are kinda expensive with limited hours. but im planning to go back to work soon when my husband comes here. do i have to cancel my medi-cal insurance so it would effect my petition? or looking for a part time job will be a good option? please help me thanks!

Timeline

It will only affect your Affidavit of Support for your husband, on which your income must meet 125% of the poverty level in the US, after certain welfare benefits are subtracted. If you're not currently employed but happen to have significant personal wealth you can show support that way. If you can't meet the requirement at all, then you need a co-sponsor, someone who will agree to be financially responsible for your husband, should he and you have financial problems. There's lots of information on AoS co-sponsors here on the forums.

Other than that, your welfare status shouldn't have any affect at all on the visa process.

USCIS (128 days)

January 8, 2011: Mailed Petition for Alien Relative packet to USCIS.

February 1, 2011: Received Notice of Action 1.

May 16, 2011: Received Notice of Action 2. Case handed off to NVC.

NVC (41 days)

June 24, 2011: Mailed Affidavit of Support packet to NVC.

July 12, 2011: Received checklist letter 1.

(Long delay intentional; not counted in processing time.)

October 12, 2011: Mailed Immigrant Visa packet to NVC.

October 20, 2011: Received checklist letter 2.

October 26, 2011: Mailed checklist letter response packet to NVC.

November 4, 2011: Received interview letter. Case handed off to the consulate in KL.

Consulate

November 12, 2011: Completed medical exam.

November 19, 2011: Picked up results, everything clear.

December 1, 2011: Interview - approved!

December 8, 2011: Visa in hand.

POE and beyond

February 5, 2012: POE at JFK, no problems.

February 29, 2012: Applied for and received SSN from the local SSO.

April, 2012: Applied for and received state ID at the DMV.

(Slight delay, had to redo biometrics at the local service center.)

April, 2012: Conditional green card arrived!

Removal of conditions

2014 is right around the corner...

i will use my parent as my co-sponsor & their income meet the 125% poverty level for the affidavit of support. so you mean to say that my medi-cal program wouldnt affect my filing for a petition for my husband becuz im scared that visa will be deny becuz of my medi-cal program.

this is what i read here:

"Not having adequate income will not usually be a problem if you have a co-sponsor, according to experiences

posted on the newsgroup, as long as the co-sponsor has adequate income/assets.

Be aware that the co-sponsor must have enough income/assets for both your fiance, any fiance children that will

be immigrating, and his/her own household. However, that IF the US fiance has been on welfare or other

government benefits for a lifetime or has no plans to work actively, the consulate can still deny the visa based on

the likelihood that the foreign fiance will become a public charge. Just having a co-sponsor may not be sufficient.

An actual case has been documented wherein a fiance visa was denied because the petitioning fiance was on

government benefits and would not be working, even though the US fiance had two co-sponsors."
