Our I-130 was approved today, barely 3.5 months after NOA1. Blazing speed!

My wife has obligations that require her to remain in Malaysia until January or possibly February of 2012. The entrance paperwork will be good for 6 months and we'd like a month or two leeway, so we're hoping to get the magic envelope in October, November, or December of 2011.

If we submit our AOS and DS-230 packets promptly it's possible that things could move too quickly, resulting in an interview before October.

I see two options:

1. Keep going as fast as we can, but request an extension on the validity of the entrance paperwork. Is there a standard way to request this? Is it usually granted? When would we request it?

2. Wait a couple months before continuing the paperwork. Is this safe? Do we need to inform USCIS that we're still proceeding, we just need a couple months time?

Any input is appreciated.

USCIS (128 days)

January 8, 2011: Mailed Petition for Alien Relative packet to USCIS.

February 1, 2011: Received Notice of Action 1.

May 16, 2011: Received Notice of Action 2. Case handed off to NVC.

NVC (41 days)

June 24, 2011: Mailed Affidavit of Support packet to NVC.

July 12, 2011: Received checklist letter 1.

(Long delay intentional; not counted in processing time.)

October 12, 2011: Mailed Immigrant Visa packet to NVC.

October 20, 2011: Received checklist letter 2.

October 26, 2011: Mailed checklist letter response packet to NVC.

November 4, 2011: Received interview letter. Case handed off to the consulate in KL.

Consulate

November 12, 2011: Completed medical exam.

November 19, 2011: Picked up results, everything clear.

December 1, 2011: Interview - approved!

December 8, 2011: Visa in hand.

POE and beyond

February 5, 2012: POE at JFK, no problems.

February 29, 2012: Applied for and received SSN from the local SSO.

April, 2012: Applied for and received state ID at the DMV.

(Slight delay, had to redo biometrics at the local service center.)

April, 2012: Conditional green card arrived!

Removal of conditions

2014 is right around the corner...

You're fine...I was in the same boat but for different reasons.

You can sit on the I-864 and DS-230 paperwork for up to a year after it arrives at NVC before the NVC would start taking action on a 'dead case'. You can go ahead and pay the fees and send the DS-3032 though. NVC will simply send you a reminder message that they are waiting on your forms.

06/15/2013 - I-751 Sent

06/19/2013 - NOA 1

07/17/2013 - Biometrics

08/19/2013 - Case transferred from VSC to CSC

09/17/2013 - Approved!

09/23/2013 - Received approval notice.

10/09/2013 - Card received. Fini!

N400

12/18/2017 - N400 submitted

12/19/2017 - NOA

01/09/2018 - Biometrics

04/10/2018 - Interview

04/27/2018 - Oath

Yup, can 'go slow' at NVC, for up to 1 year.

Plan accordingly, meh.

I choose the second option but you don't need to inform USCIS, you need to contact NVC about that.

The visa validity will not be extended, so option 2 is best of the two. No need to contact NVC about your intention to go slow. Just go slow.

What I would do is a hybrid of 1 and 2. I would go as quickly as possible until it's time to actually mail the final package (DS230 and civil documents) to NVC. Then, I' would send them that package in early November for a January interview target. Adjust the timing to fit your circumstances.

This way, you know EVERYTHING is ready and that the waiting is your choice.

Resurrecting my own zombie thread. This is exactly what we did (see my sig) and the timing worked beautifully: her interview will be December 1st. Just figured I'd update the thread for posterity!

December 2009 -- Visit to Malaysia.

February 2010 -- Applied for B2 visa, approved.

March 2010 -- Visited US.

April 2010 -- Returned from US.

May 2010 -- Sent in K1 Visa application.

July 2010 -- Received NOA2 in 71 days from NOA1.

July 2010 -- Packet 3 received.

August 2010 -- Cancellation of K1 Visa application.
