If my affidavit of support filed a 1065 form on their taxes for the past 3 years due to the fact that they own a restaurant business...can I still use them as my support..??? I believe they also filed 1040's but their business is much more profitable then what they made as their annual salary on their checks...

I would appreciate some help on this.. thanks! (just trying to get ahead start even though my petition hasnt been approved yet..hopefully soon though!!)

The sponsor's 1040 is what is evaluated. If that person is self employed, then line 22 of their most recent tax return is the income considered.
