Timeline

So, I have already filed for K-1 Visa and Im planning to file CRBA for our child that is on the way. My girlfriend wanted me to speak with a friend of hers that is dating someone that has been through theses kind of situation or so he says. I spoke with him on Sunday and he was very adamant that any child born abroad to US citizen cannot receive citizenship of the US and that it is important that the child is born here. Is this true? My intuition says no because How is it that the US govt creates a law that can not be used. didnt make sense to me when he said it and for the sake of my girlfriend I didnt argue with him. Next question is he went on to say that he can have my girlfriend here in 2 months with the help of commercial visa personnel and lawyers. Once again my intuition went berserk thinking that this sounds like visa fraud to me...and being an engineer I dont want a situation if im trying to apply for Top Secret clearance I get denied because of a silly mistake such as this one. I dont know and Im seeking advice from you guys. Does any of this sound legit or does it smell a bit funky to you? Let me know. I told my girlfriend that we should just be patient and wait it out if all goes well she can be here in 10 months or less and our baby will have citizenship through CRBA. Was this the right thing to say? Thanks

9/13/2011 @ 11:30am GMT+3: Our Son is born. (^_^)

10/18/2011: 157 days later Receive Confirmation Email that we received NOA2 (^_^)b

10/27/2011: NVC Sent Case to US embassy in Moscow.

11/02/2011: NVC Received case in US Embassy in Moscow.

11/5/2011: Received NOA2 Hard Copy from VSC

11/11/2011: Our son receives his first Passport (Russian)

12/28/2011: CRBA Interview in Moscow @ 2pm (***APPROVED***)

12/29/2011: K-1 Interview in Moscow @ 8am (***APPROVED***)

1/13/2011: Sasha receives his CRBA Certificate and US Passport and is now a Dual Citizen (WAY TO GO SON!!!)

1/23/2011: Visa is Officially in Hand. Let the preparations begin.

3/30/2012: POE John F. Kennedy Airport New York (I CANT WAIT!!!!)

6/1/2012: Proposed and She said yes!!!

6/7/2012: Finally Married in Annapolis - Mr & Mrs. Temidayo (^_^)b

Do not listen to this "friend" of your girlfriend's. About anything.

Totally a scammer. US Citizens give their children derivative citizenship by blood if born abroad, as long as that person has lived in the US for some time. If you have lived here all your life, then your children will be citizens. File a CBRA. Why are you listening to a russian about US immigration laws? :)

Timeline

You are receiving sound advise from everyone on VJ. Any child of a US citizen is a US citizen at birth.

The February 2001 Child Citizenship Act (CCA) says that a child who is under the age of 18 and was born outside the U.S., and has at least one U.S. citizen parent automatically acquires U.S. citizenship upon entry into the country as an immigrant. No further paperwork is necessary. The parent may request a Certificate of Citizenship and U.S. Passport for the child if proof of the baby's American-ness is desired.
