My dad has had a work permit for about 20+ years and has always gotten it approved. This year, he did all the procedures and sent in the app for the EAD since Feb. 28th and got the notice that it was received. I know it takes 3 months to process and this past Saturday I got an email stating that they sent a paper in the mail on the 9th that they needed more evidence/info. I checked online at USCIS and it says the same thing. We haven't gotten anything yet so my dad went to his lawyer's office and talked with his secretary about what he'd need. She told him that his case was closed because he hasn't had any court cases lately and that they denied the petition even though we haven't gotten any notice of being denied. Please help! He also has an I-130 from his brother that petitioned for him in 2001 if that helps.

1. No visa, he got in when Reagan did the amnesty to immigrants.

2. In 1998 he lost a court case to apply for a green card and his lawyer had been petitioning for work permits since then.

3. Current status is just using work permit, he still has to wait a few more years to become a permanent resident through the I-130.

So what is his status? Does he have a 245(i) application pending?

Why are talking with the lawyer's secretary? What does the lawyer have to say? Which case was "closed"?

He does have a 245i pending along with the i-130, his only status is basically an alien authorized to work in the US.

He made an appointment with his lawyer already, but the secretary says that the lawyer will say the same thing she said. The thing is, she supposedly got a notice about the "closed case" and was "about to call" my dad when she got it but he called before she was going to call him. She didn't show him any evidence about what she said. Now all we can do is wait for tomorrow when the lawyer can talk to my dad about it. I sense something sketchy though, why, out of the blue, would they deny the I-765? We still haven't received the paper in the mail asking for more evidence and when I go online and call to USCIS they don't tell me it's closed.

And the "closed" case is my dad's I-765 petition to keep working with a permit.
