Went to the DMV in California today

Hicham and I went to the DMV this morning as he finally received his SS card and we wanted to see about getting a state ID. We filled out the form and waited our turn, then got called and paid the 21$ blah blah blah then the lady left for a minute or so and came back and gave us our money back. She said that he could not get it unless his I-94 was extended because it has to be valid for at least 60 days to get the ID. We were one week short of those 6 weeks I guess... which I don't understand because his I-94 expires on 10/31/06. So she said to get it extended which I guess means he needs his Greencard. I'm sure someone else has done this and I could have known before going that it was not possible but we wanted to try beause when we went before the man at the DMV said he only would need his SS number first.

So do we need to wait to get his Greencard before we can get a California ID card for him or in California can you use your NOA1 from AOS?

Anyone know?

IIRC = "if I remember correctly". Sorry for using internet slang! :)

Yes, I'm talking about the EAD you'll get 70-90 days after you file for AOS (assuming you file for EAD of course). I guess California wouldn't accept the temporary EAD as they have this 60 day rule.

Have him apply for an EAD docuement. That will legally extend his stay here in the eyes of the DMV for another year.

This comes right out of the federal REAL-ID Act that all states are in the process of implementing.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

REAL ID act also state's that NOA1 for AOS is good enough to prove legal presence, but California choose to ignore that.

Before issuing a DL/ID, a state shall require and verify valid documentary evidence that the person: (i) is a U.S. citizen, (ii) is an alien lawfully admitted for permanent or temporary residence, (iii) has a conditional permanent resident status, (iv) ) is a refugee or has been granted asylum, (v) has a valid, unexpired nonimmigrant visa or nonimmigrant visa status, (vi) has a pending application for asylum, (vii) has a pending or approved application for temporary protected status, (viii) has approved deferred status, or (ix) has a pending application for adjustment of status to that of an alien lawfully admitted for permanent residence or conditional permanent resident status

I know....sux!!! I ran into the same problem here in Nevada...they wanna see something with a date showing the length of their legal presence. Couldnt even change my wifes name on her SSN card based on marriage without an EAD, despite my protesting that no one is obligated to file for EAD.

The SSA worker even insisted that my wife was now a K3....that is when I gave up with them....she can change it in 20 years for all I care now as I will never again in my lifetime go to one of those card centers and sit there for three hours only to deal with a dummy.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Indeed. I'm lucky I live in PA, that does accept NOA1, the only limit there is with NOA1 they only give you a DL valid for 12 months. Still better than nothing!

I'm having trouble with this too. When I arrived I got a license that was valid until my I-94 ran out. After that, I was told that I could present the NOA1 from my AOS and that would be enough.

Apparently not!!! When I tried to get my license extended, they said my AOS needed to be approved first. That of course will take a year or two. I guess I'm just gonna have to drive round on my UK license. I'm in Missouri btw.
