HI! My husband has rcvd his packet 3 for the K3 interview and it says that he can come in on any Tuesday or thrusday for the interview when he's done with the medical. However, I'm at the stage where I'm sending the I-864 and IV fee bill of the IR-1 process. Do you think he should go for the K3 interview and then, when the I-130 case arrives at the embassy, go for that interview as well? Will getting a K3 visa be a problem for the IR-1 interview? We prefer the IR-1 more than the K3. Should I cancel the K3 interview since it might pose a problem for IR-1 interview? Once the case arrives at the embassy, it usually takes a month for the interview to be shceduled for the IR-1 in Colombo. Please give me your input.......... Thanks!

You can opt to do the K-3 interview and enter the US on the K-3, as well as continuing the process through the NVC for the CR/IR-1. A K-3 visa will not affect the CR/IR-1 interview. Returning to the consulate for the CR/IR-1 interview after having entered the US on K-3 is one of the two options one has to gain immigrant status. What you will be up for is the added airfare of the return trip. If this is not a matter of concern then going back for the CR-1 is IMO the best option as AOS in the US can take quite some time.

Your IR-1 process at the NVC will take at least 6-7 weeks from now before it will be transferred to the Embassy/Consulate. So he is better off going to the K-3 interview now. Once he has the K-3 visa, he can again go to the Embassy for the IR-1 interview and they will change his visa type. The reason why I am saying this, is if the Embassy needs more documents, information from him, then he can obtain them before his IR-1 interview.

It took 78 days to complete the NVC process

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
