Hi All,

I am ready to file for I-485 for my wife, she came here on a K1. I have few questions.

1. Her I-94 expires in July, do we file before her I-94 expires or we can wait few months?(We are already married now)

2. Do we need certified copy of marriage certificate or just a regular copy?

3. Is K1 visa holder allowed to work prior to filing for AOS.

1. Technically, you should file before the i-94 expires, but many K1 entrants do not. I have only read of one VJ member who was caught during a road check and she was required to apply for AOS immediately.

2. Yes, a certified copy.

3. No, a K1 holder is not allowed to work before getting an EAD.

hmmm

1. I may be wrong but you need to apply for the AoS before the end of 3 months because it automatically changes their immigration status, as the i-94 is only valid for 90 days and if you apply for the aos you are allowed to stay under the potection of the attorney general as the aos goes through (i think i read somewhere it is possible to file it a little later but not 100% sure, so if i were you i would file as soon as possible)

2.Pretty sure this has to be a certified copy

3. From the majority of whati have read unless otherwise stamped at PoE she is not allowed to work until EaD is recieved during AoS application

Nearly there, and for those who are just starting the k1 it is a long wait but once it is over the time feels well spent

Timeline

You must AOS before the beneficiary dies....there is no time limit.

Certified copy, get it from your county clerk.

No, must have EAD or GC to legally work.

Phil (Lockport, near Chicago) and Alla (Lobnya, near Moscow)

As of Dec 7, 2009, now Zero miles apart (literally)!

5/23/12: Sent out package
2/06/13: APPROVED!
