Filing AOS & AOE - payment question

Hi,

We are getting married tomorow (Saturday, Sept 9th) and will be submitting all the paperwork for AOS/AOE on Monday - first day we can get it out in the mail. Do we need to send two checks for the forms? I read somewhere that under certain conditions you don't have to send payment for AOE - though I am quite confused and unsure. Any information would be apprectiated.

First congrats on the wedding.... will you have your marriage certificate on Monday??? you need to send it with the AOS...

We sent checks for each of the applications we filed for.... I-485 + Biometrics and then Employment Authorization Document..

Not sure what you meen by AOE..

I meant EAD ... I seem to be having one of those days where my brain just doesn't seem to want to work. I think we will have a copy of the marriage certificate by then. Thats a good point and one I now need to follow up on, when we filed for the marriage certificate they gave us a package of things to give to the minister, so I will have to ask him. I think we can take it down to the court house and maybe walk it through if not.

Which brings me to my next question: we are cutting it really close to the 90 days on the K-1 visa, how soon do we need to file the AOS? Does it need to be received by them before the 90 days is up?

Where are you getting married? Most places the marriage certificate is only available once the minister has filed the paperwork after you get married with the County Clerk's Office, so usually a few weeks after the marriage.

the K1 says you should get married within 90 days . The AOS part can be done outside the 90 days. The getting married part is the most important(within 90 days). AOS can be done anytime outside that but don't let it be too long.

You need to be married within the 90 days... you do not need to have filed for AOS within the 90 days.... The paperwork you give to the minister is your marriage licence the certificate is issued by your state and has a raised seal on it... most people have to wait at least 3 days to get this .... in some states it takes 2 weeks or more...

Thanks! That takes a lot of my mind - we are definately within the 90 days, but thought we had to file the AOS within that time as well, we have almost all of the paperwork ready to send in.
