My fiance arrived a week and a half ago. Hooray!

I want to apply for the social security card today. There is a question that asks if he is a legal alien allowed to work or not allowed to work. Which one is he?

If you apply in person (which you must do for an original SSN application if age 12 or older) You DO NOT I repeat DO NOT need the SS-5. They will enter everything into the computer based on the evidence provided and the answers to the questions they ask. They will print out the info entered for you to review. You don't even need to sign anything.

hmmmm reading this has confused me now, you say allowed to work am i right to assume this is just for the ssn but still not able to work until they get their EAD when they apply for AoS?

hmmmm reading this has confused me now, you say allowed to work am i right to assume this is just for the ssn but still not able to work until they get their EAD when they apply for AoS?

An individual assigned an SSN based on K-1 status will be issued an SSN card with “VALID FOR WORK ONLY WITH DHS AUTHORIZATION,” printed on the card.

An SSN card having the legend, “VALID FOR WORK ONLY WITH DHS AUTHORIZATION,” only means that the number holder cannot use the SSN card as proof of authorization to work in the United States. It does not otherwise affect the validity of the card or number.

You may wish to review form I-9 to determine which documents can be provided as employment authorization.

we did have to fill out the form. it was pretty hassle free, however we discovered that they entered his name wrong at POE so we have to contact immigration to have his name corrected and then go back to social security because the card they are sending us will also have the wrong name.. what a pain!

Hmmmm. true that you dont even need to sign a form or the receipt. But the first thing they ask is if you completed the form. Maybe that's ow it works for your local SSA office, but I completed the form and they asked for it. Same when I went to have my name changed on the card.

So you are saying that you didn't have an already completed Form SS-5 and they made you complete one?

correct. i went to the office, filled out a form, had my fiance sign it and they issued us a receipt that the card will come in the mail.

however, they entered his name wrong at the POE so the card will have the wrong name on it because they can only use the name attached to the I94. therefore, have to go to border patrol today to fix the name, and go back to social security again to re-issue a card with the correct name.
