Packet3: MARRIAGE AND DIVORCE CERTIFICATES?

Hi, since we recently got our NOA2, I was checking the K1/K3 packet 3 instructions and noticed they require both marriage and divorce certificates???

I (the beneficiary) am divorced and have my divorce certificate but now I´m concerned about the marriage certificate specially since I´m not even living in my natal country (were I got married) so it will be kind of difficult to get...

Can someone please clarify this for me?

The marriage certificates are not required for previous marriages for which you became divorced....The marriage certificate is required for CR1.

The marriage certificates are not required for previous marriages for which you became divorced....The marriage certificate is required for CR1.

Great answer and great link to a logical reason why a marriage certificate is not required, when documenting divorced status.

May 19, 2011 Notice of Receipt from Laguna Niguel, California, Service Center

August 2, 2011 Request for Evidence

August 31, 2011 Evidence tendered to Laguna Niguel, Service Center

September 14, 2011 Notice of Action, "Petition approved."

September 29, 2011 Notice Petition forwarded to embassy in Lima, from National Visa Center, Portsmouth, NH,

October 3, 2011, email sent to embassy in Lima, re: change of address for fiancée.

October 5, 2011 email response from embassy in Lima, re: procedure for change of address

October 22, 2011 received packet from embassy in Lima with Nov. 2, 2011 appointment date.

November 2, 2011 finacée interviewed by consular staff in Lima.

November 2, 2011 Yellow sheet issued requesting more information.

congrats on your noa2 im not sure but i think that packet three might not only serve for k-1 visa..i would belive as long that you have certified copys of your divorce you should be ok..so far i we havent recieved noa2 but i was also married twice before this k-1 process and i sent them certified copies from court house and while i was there i got my previous marriage lic...so i have them just in case they ask..in your case i know your not there to get them..i hope you can browse v.j to get more info but i would think that maybe you can contact were you got married and maybe order them on line and maybe have them sent via fed ex or something i didnt see your time line but you said you got noa2 recently so you might have some time to put it together..but like i said certified copies im pretty sure it will do good luck in your journey :thumbs:

I hope so... But then it wouldn´t say "married persons or previously married"

This is what it says:

MARRIAGE CERTIFICATE: All married persons or previously married people are required to present a certified copy of their marriage certificate. Certificates of marriage from the U.S. MUST be original certified long-form copies from the Office of Vital Records from the state where the marriage took place. No other marriage certificate will be accepted as proof of marriage in the U.S

The packet says K1/K3 visa but still I´m really concerned about this, I´ll try to get some more info about it.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
