I'm sure this has been asked a million times, but I couldn't find the answer so I apologize...tomorrow we're going to apply for my fiances Social Security card, but I'm not sure which box to check for question #5 'Citizenship' question. Do we check the box 'Legal alien allowed to work' or 'Legal Alien not allowed to work' (which if we check, apparently we need to provide them with some proof as to why he needs a Social Security number). We have not yet filed for I-485 or I-765...

K-1 Visa
05/17/2010 – Petition mailed to USCIS via certified return receipt.
05/27/2010 – NOA1 issued
06/03/2010 – Touch/NOA1 hard copy received in US Mail
10/27/2010 – 5 month mark
10/28/2010 – Spoke to USCIS representative – 'still pending'
11/04/2010 – Spoke to USCIS representative – 'still pending', but service request generated
11/05/2010 – Notified that background checks are not complete - looks like we're in for a looong wait...
12/07/2010 – Received email notification of NOA2
12/16/2010 – NVC sent the case to Embassy in Malawi
02/28/2011 – Interview
03/14/2011 – VISA APPROVED!
05/04/2011 – Fiance and I came back to the U.S. together! smile.png

07/02/2011 – I-485 packet mailed to USCIS via certified return receipt.
07/06/2011 – Packet accepted.
07/07/2011 – Check cashed and NOA1 issued.
07/22/2011 – Received biometrics letter.
07/29/2011 – Biometrics completed (walk-in)
08/23/2011 – EAD Approved
08/31/2011 – EAD card arrived in the mail.
09/12/2011 – AOS interview - APPROVED! GC production ordered
09/21/2011 – Green Card received!!!

06/13/2013 - I-751 packet mailed to USCIS via certified return receipt.

06/17/2013 - NOA issued

06/19/2013 - Check cashed

06/21/2013 - Received NOA in mail.

Legal Alien Allowed to Work..

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

Do you have employment authorization (EAD)? If not, then I think you can check "not allowed". You get a card that says it is not valid for employment. When EAD or GC comes, you fill out another form and get a card with the same number that has no restriction. We did that.

The way I read

(look C.1, there is a table, followed with another one that specifically lists who needs an EAD)

is that a K-1 can in fact work.

The presumption is that you would file a AOS and EAD shortly after the K-1 comes in the country and then it's all sorted.

(Okay, I just realized I posted this in the completely incorrect forum...wake up girl, wake up...!) :bonk:

So if we check that box, they won't give any hassle about having proof of a really valid reason to have a number? They say in the instructions that you don't need a SSN for banking or applying for school (which is weird because our local college won't even let my fiance begin the application process until he has a SSN) and needing a driver's license is not a valid reason either according to them. What do we give as our reason?

In our state, you must have a SSN to get a license, and I thought that was a valid reason. When we went to the Social Security office, we were already married, and took along a copy of our marraige certificate. We waited because we wanted Vika's married name to be on both the SS card and her driver's license. We were told that the K-1 was reason enough to get a SSN, and they took a copy of the form in her passport with her A number on it, and her picture page from her passport.

Answering for the millionth time. If you apply in person (which you must do for an original SSN application if age 12 or older) You DO NOT I repeat DO NOT need the SS-5. They will enter everything into the computer based on the evidence provided and the answers to the questions they ask. They will print out the info entered for you to review. You don't even need to sign anything.
