petition form **i am so confused**

:unsure:I think that my fiance and i sort of mess up with that form we fill in the from I-29 or what ever the name it is, because we did not fill in any letters, he just send that form Texas offices, he did not tell me that he had it to pay something, and i can be really sure that he did not pay anything. Does any one know if we did not fill it the correct stuff if this petition will reach the Texas office, is this some how can affect us on getting the K1 ? Because i did not make any letter, he did not make any letter. :help: i am about to cry , and i don´t even start the process yet hahahaha ok i guess i have to calm down first. Also he wants to fill in the form after we have a religious ceremony next year and then send it, that´s on JUNE 30 2012, because we have not reach 2 year relation ship that HOMELAND SECURITY WANTS US TO HAVE. Do i have to wait until i have 2 years of relationship with him. Would you recommend to be marry by the law first in Mexico an then apply for the K1? i am so confused!!!

You cannot apply for a K-1 if you are married. K-1 is for fiances. So no, I would not recommend getting married because then you would be ineligible for a fiance visa. Also, you do not to have a 2-year relationship. You only need to have met in person in the last two years. You could have met yesterday in order to file the petition. CHeck out the guides up top. The requirement is that you have met in person at least once within the last two years of the date of the petition, NOT be in a relationship for two years.

I think you are talking about the letter both of you write that say it is your intention to marry each other within 90 days of arriving in the US on a K1 visa. If those are not included, an RFE for them will be generated.

If the petition fee was not included with the paperwork, it will be sent back to the sender.

OK, you need to take a deep breath, calm down, and then - read the instructions for K1 carefully, multiple times.

1. You do not need to be in a relationship for two years before being able to file - people file for the K1 after weeks of dating. You can file at any time, but you have to be able to show that you have met IN PERSON within the past two years from when you file.

2. You CANNOT get married before filing, if you want to go the K1 fiance visa route. It is called a "fiance visa" for a reason - if you marry first, then you would apply for a spousal visa - entirely different process. The K1 will allow the foreign fiance to enter the US, and then marry the US citizen within 90 days from arrival. If you are already married, the foreigner is no longer a fiance.

3. Yes, there are fees included to any immigrant process, no matter which route you take. When you say "he did not tell me that he had to pay.." - who are you referring to? A lawyer? Your future husband?

If you just send in the I-129f form, without any of the additional forms or supportive documentation and without the correct fees, it will be rejected, and you will need to file it again.

You can get a matrimonio religioso if you want (that does not count as far as the government is concerned), the one that counts is the matrimonio civil and that is the one that you should not do if you want to go the K-1 route. If you do el civil, then you would need to do a K-3. I might be wrong, but it seems to me that a K-3 takes longer.

K3 is an obsolete visa type in practice (even though it's still on the books). If the OP were to legally marry in Mexico (matrimonio civil), then the visa type they would pursue is the CR-1. Posted processing times for K1 and CR-1 by USCIS from NOA1 to NOA2 are the same (5 months). CR-1 visa involves processing at the NVC; for K1, the NVC is a mail stop as the file makes its way to the appropriate Embassy or Consulate.

Hahahaha a :bonk: i am calm now, ok i read the guide like 3 times already and i am not that scare anymore, sounds complicated but i think it just sounds but the process is not that hard. SO THE WORST THAT COULD HAPPEN is to filled in again, good that about the 2 years, hahahaha sounded a little silly , but well i need to ask just to make sure i am mot doing something wrong. Good thing that i am going to visit my fiance on June i think it will be better if we sit down and read the guide lines together and once we have all the forms we need for I-29F then we send it again.I guess we should wait until the office send back the petition , fill in the petition again.

Hello!! I read your post and I feel sad for you but at the same time I feel good because I did the same hahaha. SO!! my thoughts for you is to REFILE the k1 VISA AGAIN. You Do NOT have to wait until you get your petition. Because they will ACCEPT your petition but that does not mean they will APROVE your petition. Im just trying to help you because It happened to me already. We File the k1 we DID NOT send all the documents ,we send just ONE PAGE the form and nothing else! Imagine that!! Can you imagine thay they send us a CASE NUMBER And we thought Well! they accept it, AFTER 6!! SIX months of waiting guess WHAT?? PETITION DENIED!!We were so UPSET so SAD!! because then we find out what happened and that we did not send anything. So !! Dont wait until you get that petition denied, dont wait 6 months, just RE FILE again , check the list that they have here and send it again, print all the letters, proves, and everything. believe me its better. If you need any help feel free to contact me!

Oh! and about the 2 years relationship,you DO NOT need to have a 2 years relationship, you have to prove that you gust have seen Each other in the past 2 years.

The post on your profile confuses me. You ask after you get your approved visa, you come to the States. Then you say you have 90 days to get married, but don't know if you have to leave the country "while the process is being done." What process?

My suggestion is to really read through the guides here... I think this process is really confusing you.
