hi my name is AL.

i just joined this group to day.I need help with my interview on 6/10/11 in the US Consulate in my homeland. let me start by giving you a a little history of my case. i came to the states in 1989 with a visiting visa and in 1991 got married to my ex-wife(US citizen)who i meet in collage,got my green card(had it for 17yrs) and we had a son whos 20yrs and his in collage now.i and my ex-wife finally divorced in 1999.in 2001 i remarried to my present wife(a US citizen) and we have 3 lovely kids.in 1996 i pleaded on content to an insurance case and asked to pay restitution of $9k. in 2006 i was on my way back from visiting my home country( which i go very yr and noting ever came up) and was stopped at the point of entry by INS officer in Houston TX on Transit to Los Angles and he said am inadmissible and i had to appear to see an immigration judge in Houston. i stay in CCA, thats the immigration detention center in Huston for 6month. After which i asked the judge to grant me voluntarily Departure which was rear in my case and he did in Feb 2007(could not sit locked up for that long, my Business and family were suffering). then i return back to my country leaving my family in the state.my lawyer is being try to get me back on a wavier and finally i have interview in my homeland for the 20th of June 2011. i want to know what this interview is about so i can prepare myself be for that day. my family is till in the states and in the past 4yrs i lost everything i worked hard for in 18yrs in the states. all i have left is my wife, kids and a 20yr old son in collage. i really will like to reunite with them, keep a close eye to my teenage son before i loose him and the rest of my family. please any advice on what to have, say or bring to this interview will be helpful.

Welcome! We will be glad to help you, but we need more details:

- Why didn't you ever become a US Citizen?

- Did you have a valid greencard when detained?

- Why were you detained?

- What were you charged with in the insurance case 15 years ago (I assume this is somehow relevant to your case, otherwise you would not mention it)? Were you paying on the 9K judgement? if yes, it is odd that they would detain you for that.

- What exactly are you applying for now? Your profile says adjustment of status, but that is only possible from within the USA. Did your current wife petition for a IR-1 (spousal visa) for you and that is what the interview is for?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Your green card at the time was it one of the old non expiring ones ? What was the exact charge in the insurance case and what type of insurance was being defrauded ? Was 9k the total amount involved ? Where there other charges involved. Was the ruling that you pay the restitution and either you didn't pay or the payments may have not been recorded properly so the original ruling now has converted into something worse? They obviously canceled your old green card so are you being applied for as a IR1 ?

This will not be over quickly. You will not enjoy this.

If your wife filed an I130 your interview at the consulate will be the normal immigrant interview verifying the relationship between you and your wife. The consular will find you inadmissable due to sounds like an insurance fraud case. At that point you will get a slip with some legal language outlining exactly what the legal reason you are not admissable is. Then you can file the waiver. They may let you file the same day or set a followup appointment to file it. Depending on where they adjudicate the waiver it can be a few months to a year before you hear an answer on if its approved.

Some consulates conduct an I601 interview as well when you drop it off.

I should ad this is if and only if the crime you were convicted of does not have a permanent bar.
