Hello VJ members, I petition my fiance April 4, 2011 and received a notice in the mail 2 days later. Shes 3 months pregnant now, So this December I will be going back to Vietnam for my childs birth. The person I have helping me file my petition said to just add the child into the K-1 petition.

I was hoping someone who went though this process can shed some light on this situation for me. What extra papers did you have to file? Where did you get you blood test done? and what will happen when she goes to her interview when shes pregnant? What will I be expecting to pay for her and my childs visa? Thanks for the help VJ

Your child won't be issued a visa because it will be a US Citizen at birth (unless you are a recently naturalized USC or have hardly lived in the US). You will file a Consular Report of Birth Abroad (CBRA) for the baby's passport. Good luck.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

There's nothing you can do until your child is born. After your petition is forwarded to the consulate, you can notify the them that your fiancee is pregnant with your child. Since you are not married, Vietnamese government will only issue birth certificate with mother's name. You would most likely be require to submit DNA test to prove biological relationship after visa interview.

If you are a U.S. citizen, go to the U.S. consulate's website American Citizen Service section and make an interview appointment for a consular report of birth abroad. Make sure you read all the requirements. If approve for CRBA, your child will be a U.S. citizen and will be allow to enter the U.S.

Right now, all you can really do is start gathering all the require documents and wait until your baby is born.

what child? There is no child yet and when it is born it will have a claim to US citizenship. If it is born before the visa is issued you will have to file a CRBA at the conslate and get the child a US passport. The child will not be eligibile for a visa, the child does not need one.
