Holly, no matter what they stamped in your passport, you entered the USA with immigration intent, without the necessary visa. You got away with it for now, but what you did was not legal and you will have to face up to that eventually. Its probably best to figure this out before you have your interview.

Actually, i didn't. We had our wedding in Nov of 2005. Originally, we were going to go the k-1 route. Our marriage license got lost in the mail (true story) and we didn't get it until march. During this time, i had been flying back and forth, never with any intent to stay. In April, we had our ceremony. After our reception in May I flew down to visit again (which i told the officer in immigration). When i arrived, my husband told me that he had just closed on a house..... i called the info line, they advised me to go the i-130/i-485 route, that way i could stay in the US with my husband. I have found my return receipts for my intended flight back, and also have proof of a family reunion i was planning on attending in July. Please do not accuse me of such a thing. I am aware of any "problems" you think this will cause me at my interview, and i appreciate you bringing it to my attention. That is why i have torn the house apart looking for that receipt, and finding the reunion invitation.

June 07, 2006- Medical done

June 26, 2006- We send off I-130 and I-485 Package concurrently

June 30, 2006- Received NOA1 for I-130 and I-485

I don't need or want dr_lha's comments either. Like I said, he/she is the only one who was offended by what I wrote. I guess basically because everyone else read the whole text. Not just the parts that fit in the picture of that specific person. Discussion over!

My husband and I were quite surprised at the grilling we received during the interview, bring everything and anything to show his stability and be prepared to answer a lot of questions about your visits.

Sit closer to the back of the waiting room so you can hear your name called.

OK good. As long as you're aware of these issues, it sounds like you're all set to go for the interview. Its best to be overprepared for these things.

OOh i've been workin around the clock getting everything together. All of our pictures have the dates printed on them. I wasn't working at the time (i quit my job in june of 05), so i was basically "free" to travel. I have lots of "proof" to my ties at home during this time. Is it advisable to bring all of the mortgage paperwork to the interview?

Agreed, overpreparedness (is that even a word!?) is a good thing here. Thanks to everyone for the advice! I think i MAY be able to sleep tonight, knowing that I have everything i need. And regarding my original topic (about the SSN), i'm just going to wait for the EAD and/or the AOS interview. I am going to the bank tomorrow, so hopefully they'll help me out. All of my other evidence should be enough. I will also be asking friends/family/neighbours to write an affidavit of sorts to say that we live together etc... We are raising a puppy together, maybe i should bring her along to the interview :lol: just kidding of course. Thanks again to everyone who has posted here. I don't know where i'd be without the wonderful people of VJ.

There is no reason to lie. Tell them just the truth. First of all, you don't have an EAD or a green card. So for what should you have a SSN now, with the limitation that you are not allowed to work, and then you go again when you have your work permission. That is nuts. They should understand that and I don't see any reason for a SSN if you don't have your work permission yet.

Show them your visa, your marriage certificate, the printed explanation for your visa...

Drown these fricking bank clerks in information if they ask for it. You are here legally, you can prove it.

I don't understand why banks have no problem to open accounts for wet backs, but once there comes a citizen of a country who is here legally they are obeying and following every rule they can find.

Well I entered on a tourist visa, and they would not issue me any kind of SS card until I recieve my EAD.

However, to the OP I was able to get a joint bank account at bank of america without one- it was very easy :yes:

The only documents the IO cared about were ones showing proof of our co-residence, he didn't even ask to see the pics until after the interview.

Again, he asked a lot of questions. I put a review up in the review section with some of the questions

I work for a bank, and we require SS or Tax ID number to be on the account. It is required by the US Patriot Act, not by the bank policy. You can apply for a tax id number, but it takes about 2 wks.

Just a note... TIN's are now only issued when the application is attached to a Tax Return. As a previous poster said, Bank of America will open some accounts without SSN.

Maybe K1 and K3 are different but I got a SSN the second week I got her, before we were married and it says VALID FOR WORK ONLY WITH DHS AUTHORIZATION. I do not have an EAD.

That ain't happening.

If not eligible to be assigned a Social Security number (SSN), your local Social Security office can provide written notice using Form SSA-L676 to explain that an SSN cannot be assigned or a card issued due to the applicant not having provided authorization to work in the United States or evidence of a valid nonwork reason for needing an SSN.

The following are valid nonwork reasons:

Dear mdyoung, did you have a look at the application form for a SSN? You can be eligible to get a SSC but at the same time it can be that you are not eligible to accept employment. Before you post something you should read what you are posting.

Yes, K-1 and K-3 are different. With a K-3 you can't get SSN the way you can with K-1.

Dont worry about a thing!!!

This is what we showed to the immigration officer:

- The registration to a car I added her name as owner to (No need for a SSN)

- Both Credit cards on an account showing matching CC numbers (Only Capitol One will do it without SSN)

- Some pics of me her and my famliy together

- Marraige photos

- Affidavits from my pops, and one from a friends stating that we are a solid couple...notorized...

- And all the other common paperwork that is involved.

I would think they would understand the SSN situation and the catch 22 you are in. For me all my bills are in my parents name as well, so I was really stuck! But all in all everything went really well.
