Is there a minimum age for k-1 interview at Manila

Hi guys,

Please dont answer this if you dont know..I posed this question in another part of this site and all I got was very negative and demeaning responses.My fiancee happens to be 17,we are in que to be schedualed for and interview soon.What I need to know is if they will still have us interview?She has an affidavit of parental consent to come here to the US for the purpose of marriage which was submitted with the original petition.

Ive called about a dozen laywers and have one representing us through this process and all but maybe 2 said it just matters if in the state where the marriage will take place that it is a legal marriage.Here in Florida it is legal with parental consent.I dont know what to think or who to believe,but I know I will be devestated if we are either denied an interview or denied the visa,We both love each other truley and deeply and have gone through alot to get this far in the process.Please dont condem us for our younger age but we both know what we want out of this relationship,a happy simple life together and a close family with a few children.We are like 2 peas in a pod,we compliment each other so well and get along on so many levels I know we were meant for each other.

If you know the answer please respond or if you can tell me where I can look for the real truth about this please leave me the info so I can contact the right people.Maybe someone who lives there in the Philippines can direct me to the right people.

I don't know if there is a minimum age in Manilla, but I know my cousin married a girl from Costa Rica when she was 17 here in California. I would not think that being 17 should matter for the USA if she has parental consent. Not sure the law in Manilla, but if it was allowed there with parental consent I think you would be fine fro her to come here.

I am not sure about Manila you may need consent from her parents. Also check out the rules in your home state, some states require notice of consent from the parent on the person under 18.

So i am wondering if it was approved by the USCIS then does that mean her age is not a factor? or if it was would it not have been approved by the USCIS right?In my state if the person wanting to get married and is under 18 they only need parental consent and then they can legally marry,which my fiancee has.

As far as US laws and USCIS regulations are concerned yes, your fiancee may be eligible to marry at 17. But you and Irish will also deal with the Manila embassy who will make sure that you are compliant with both US and Philippine laws.

Yes, it will be a problem. As far as the US embassy is concerned, Irish will not be compliant with Philippine law. Art. 35, Chapter 3 of the Family Code of the Philippines, states that x x x “The following marriage shall be void from the beginning: (1) those contracted by any party below eighteen years of age even with the consent of parents or guardians. True you’re not marrying here but in the US and she would have turned 18 then. But Philippine law and our Immigration officers will prevent your fiancee from departing the country for purposes of marriage until she's 18. She will not pass CFO seminar which is a requirement for departure. Moreover, a 17 year old cannot travel alone without Dept. of Social Welfare & Dev. clearance. So she will be needing clearances from two govt. agencies, CFO and DSWD, and I guarantee you, both clearances will be denied.

The affidavit was signed and notorized by a judge in Somboan, I also have done this through a laywer who told me that was all she needed was a signed and notorized consent from her parents.

I assume you spoke t o a US lawyer who is not familiar with Philippine marriage law? At any rate, judges and lawyers make mistakes and they can be charged with gross negligence of the law. Even if consent was given, our law says such consent is void. We cannot argue with written law.

Best thing to do under the circumstances is to delay the interview until after she turns eighteen. Wait a few more months. This will give you at least a fighting chance.

The next issue that the embassy would be looking at is the age difference between you and your fiancee. If there is a huge gap, better prepare yourself to prove bona fide relationship. It will be tough.

Darn.....Okis here it goes.....Call the consulate in Manilla .......They would be more likely the one's that know their own rules.....Or you can also have your fiancee go to the consulate before the interview and ask......

I'm glad to see that you've weathered the storm.

I recall that one poster in your other thread gave a well presented answer to your question based on his personal experience. I would recommend that you talk with a US immigration attorney who practices in Manilla, such an attorney would have broader experience some of which may be different from that of the VJ poster for one reason or another. Or the attorney may confirm the VJ poster's experience. Either way you can feel more comfortable that you've gotten a knowledgable answer.

I do not recommend asking the consulate unless you can go there in person so that you know that the person you're talking with both understands the question and is in a position to give an authoritative answer. You're unlikely to get such a person answering phones.

Yes, upon reflection I agree this is the more appropriate forum, however the responses are still the same. Seeking legal assistance appears to be the way to go for this gentleman, and it's been said more than once, in both forums. Or as Yodak states, to consult the Consulate.

I think it was probably placed in the K-1 forum due to the title.

:unsure: Sorry Yodrak, of course you're correct. I was a bit confused. You suggested an immigration attorney that knows about Bangkok, you actually told the OP not to phone the consulate, but to go in person, if he must.
