Timeline

I have been employed at the same company for 12 years. All my income comes from this company and I have my W2's and 3 years of tax transcripts. But in 2010 I was on Maternity Leave Disability, and a portion of my wages came from state disability insurance. If I only include the tax transcripts from my wages earned through my employer for 6 mos. of 2010 my income does not qualify.

I have requested payment history be sent to me from California State Disability which I can include with the AOS packet and would bring my 2010 income to well above the guideline needed to sponsor.

I do have the last 6 months of pay stubs showing my continued employment with the same company after maternity leave and that I am making more than enough to sponsor my husband.

So my 2 questions are:

Do I HAVE to include the maternity leave disability payment history if I show I am back at work making more than enough?

And if I DO have to include the disability pay, does that mean I can't use the I-864ez?

Will your W-2 without the Disability have you above the required income level? If so, I don't think you need the Disability evidence. However, if it doesn't you will need to include it and therefore you won't be able to do the EZ. Mytwocents.net....LOL :thumbs::unsure:

I was going to say you will be fine with showing you are currently employed and pay stubs to reflect you can sponsor your hubby. All the best JAP! :dance:
