Ok - so I just got off the phone with USCIS to request a copy of my NOA2 for our interview only to be told that me might NOT be approved bc their system does not show it as being approved.....ummmmmmmm #######???!!!! We got our letter from Department of State on April 22 and my fiance' got his packet from the Embassy on April 26th! What do you mean we might not be approved????

Has this happened to anyone else?????

We got our letter from Department of State on April 22 and my fiance' got his packet from the Embassy on April 26th! What do you mean we might not be approved????

Did you or did you not recieve the I-797 in the mail from USCIS stating that your petition was approved? Why are you requesting a copy of your approval notice from USCIS?

The only thing I have received from USCIS is our initial I-797C which states that the I-129F has been received. They told me I should have gotten a notification from them that the petition was approved. They called it an "approval letter", but I know on here everyone calls it a NOA2.

Did you or did you not recieve the I-797 in the mail from USCIS stating that your petition was approved? Why are you requesting a copy of your approval notice from USCIS?

I see from your timeline you get updates through the USCIS webpage("touches"). Didn't you get an email notification of the approval?, and what is your case status online?

What doesn't make sense is NVC confirming they sent it to the embassy(you probably have your USCIS case number and NVC/embassy number by now). They only recieve approved petitions. It sounds as if there's something wrong or not updated in their system. If your case status online says post decision activity call USCIS up and say the embassy requires the approval letter from USCIS and have them send you a copy of NOA2 - just remember to say you never recieved it in your mail when that's the case; as far as I know, it is expensive to get a copy if you just misplaced it.

Btw, NOA2 is not the official name for it, infact it would be a NOA3 if you had an RFE.

SLCPLP, you will need to find out about this missing NOA2 at some point...

In the meantime, I'm curious if you were to call the DOS if they would have and LND number for you...

you say you called uscis, you should be calling department of state NVC,603-334-0700.they should tell you your case is complete and give you the case number, fo the interview.the noa-1 when first receive by the uscis...the notice of action,noa-2 1-797,date your application was adjudicated petition has been processed and final decision has been made, approved.

Something really strange going on at the VSC...we got NOA2 I-797 approval and hard copy last month. Approved date was 4/27. Most of the time the NVC recieves within 7 days...they ask you give 15 days before calling, but 7 days is the norm. Well, ours is not there. I have called NVC, not much they can do as they do not have record...they are researching after i sent copy of I797 via email to NVCResearch@state.gov. The problem is USCIS will only say that the petition was approved and give me date. Well, hell, I know that...but where is it..NVC should have recieved...or course their textbook answer is it may take 90 days..####### 90 days, never heard of that!!! NVC says thats crazy. Some posts on here say USCIS is asking for petitions to be returned from NVC...due to issues...hope mine is not in that bunch. VSC was crankin out approval several weeks ago...maybe some rogue officers bypassing regulations..God I Hope Not!. The issue I have is USCIS will only say it's approved. When i asked them "well, has it been mailed", they will not answer...just "it could take 90 days". BTW the CS people are not at the VSC itself...it's outsourced, so they can only see what's in system..really Sucks!

A friend of mine had the same case like you. She never got an approval notice from USCIS (NOA2), her case was routed to the NVC directly. She got packet 3 and had her interview, no problems. She got her visa some weeks ago and was on the plane to the US yesterday. So you are approved, even without getting a NOA2. The only problem is, for AOS you will need your NOA2. So better try to get one, I heard if you try to get it later, you have to pay some hundered $ for a copy of the NOA2.

I would check on-line with the USCIS site to see if your NOA2 is registered on the Web site. In our case, we had to have a copy of our NOA2 for the medical, and, the embassy interview. Also, we had to have it to file for our AOS. I would use every means possible to get a tangible copy of your NOA2. Throughout this process it is far better to be safe than sorry.

Same thing happened to us - I got a letter from NVC saying they had received the approved petition, (now) husband got Packet 3 in the mail, etc, but no NOA2 ever showed up AND the online system for USCIS continued to say "initial review" or whatever.

I called USCIS at least 3 times (several times I was told that the petition had not been approved even though by the last time I called my husband was IN THE US on a K1!!), finally requested to be elevated to non-script reading person and it turned out that the problem was that the adjudicator had approved the petition but neglected to do whatever needs to be done in the computer system for it to register with USCIS as "approved." The person I spoke to on the phone said that ONLY the original adjudicator can do this, so she had to put in a request for that person to update the computer, and once that was done an NOA2 was automatically generated and mailed to me. You WILL need the NOA2 for adjustment of status, so be persistent!

Thanks for all the replies EVERYONE!

Firstly, the entire question began when I got the letter from the Department of State and yet the USCIS online info still showed "intial review."

Ok so I did call the Department of State and they acknowledged that they do indeed have a file on us and everything has been forwarded to the US Embassy in London (which I knew bc my fiance' already has the packet). The lady I spoke to told me that they would NEVER have sent it on to the embassy if they didnt have an approval from USCIS. However, she was hesitant to guarantee that there wasnt a problem on their (USCIS) end.

I put in a service request with USCIS so we will see what that gets us.

Scott&Annie: I HOPE TO GOD that isnt the case with us either....however, the way things are going nothing would surprise me anymore.
