I came on a K1 visa to the US almost 3 months back. However, as soon as I came, me and my fiancee decided to not go through with our marriage. During our fights, I had moved to a friend's house and there I met a wonderful man and now we are planning to get married.

But, many people are telling me I have to go back to Manila to restart my fiance visa applcaiton on my new fiance's name. However, we really do not want to be apart and my fiance does not have the time to go to Manila with me for now. I know many people here do not like people like me who only want to immigrate but I can assure you I am not like that.

Please help me by giving me advice as to what is the possible way I can stay here with my new fiance. We are ready to get married immediately. But if required, we can wait if there is some other way. I will be contacting some immigration lawyer but not all lawyers are that good and we don't know whom to trust so I thought to ask here. Please help by letting us know of any method so that I do not need to go to Philippines right away.

You get no sympathies from me. Women like you are exactly why the USCIS and the Consulates have to be so critical and scrutinize everything with this process.

You are free to marry anyone you want. You can marry the new guy but you can't stay here after the marriage. You still have to go back. There is NO way you can stay here legally on the K-1 visa you obtained through the previous guy. NO WAY WHATSOEVER!

No matter how you slice it--or how your lawyer slices it--you need to go back and go through this process again. And it won't look good for you. You're going to have to sincerely prove that this new relationship is sincere and that you won't just breakup and find another guy yet again.

Remember, we might criticize this woman for finding another man while she's in the US, but we should equally criticize those men/woman that constantly shop for woman overseas and then drop them like a bad habit at the first sign of trouble. Not saying that anyone on VJ goes shopping, so dont take that wrong please!

Or maybe we shouldn't criticize folks here at all. Nah, that wouldn't be any fun.:pop:

You mean we don't already? It's a complete given in my book. Those who shop around and "drop them like a bad habit" should be criticized.

It's a sign of the times that in this day and age one can't critize anyone. Even shunned from critizing pedophiles on VJ. Simply amazing. Perhaps if there were more social ostracism to divorce, the US would NOT have a whopping 66%+ national divorce rate? In the olden days when people could criticize and socially ostracize, the divorce rate was almost non-existent. Hmm, I wonder if there is a correlation there.

I'm hear you SirLancelot! I just found it amazing how many folks went out of there way to defend the pedophiles on this site instead of shun them. Instead they actually give them free legal advice!! I don't know what the hell is up with that, but I sure the hell hope that the lack of support for good morals and values on this site doesn't mean something more sinister may be brewing here. You make another good point about the incredible divorce rate in this country. Perhaps if there were less divorces and less single mothers and fathers, then we wouldn't have nearly as many problems with the crime rate amongst our youths (particulary inner city) in this country. It's a fact that a child that comes from a stable house with a mother and father raising them in a sensible manner is much more likely to succeed in life than one that had to rely on just a mother or father. Peace!

It's a sign of the times that in this day and age one can't critize anyone. Even shunned from critizing pedophiles on VJ.

Mary Magdalene was criticized and almost stoned to death because the moralists hated that she was a prostitute. But did Jesus judge or criticize her? No, he said, let the first one who has not sinned cast the first stone.

Those of us who likes to criticize hide under the anonymity of the internet. If it was our adult friend dating a 17-year old, I doubt very much if we'd call him a pedophile straight to his face. We'd probably say "cool dude, whatever makes you happy" even if it goes against our morals. So why can't we be the same on VJ? Let's stop calling each other names and just agree to disagree in a diplomatic manner.

Ah, the great moral majority, where would we be without them?

As for the real advice, as far as I can see you haven't done anything either illegal or likely to prejudice your new petition. However, if you want to try to stay here and adjust status, I think your only course of action is to consult a good lawyer to see if that is indeed an option.

It would be nice to think that anyone who has done this in the past and can offer some personal experience of what happens in this scenario can post same. From the looks of this thread though, anyone who did so would be witch hunted, which is a great shame as part of what makes VJ interesting is reading about what actually happens to real people going through the same experiences.

Anyway, just to say, I wish you all the best with what ever action you end up taking.

Refusing to use the spellchick!

I have put you on ignore. No really, I have, but you are still ruining my enjoyment of this site. .

karo,

Yodrak did not say that there was a way she could stay. Yodrak said that she should consult with an attorney.

I don't mind being ignored, I do mind being mis-represented.

Yodrak

Funny the ONE thing that caught her eye out of ALL These posts was Yodrak saying there is a way she could stay...

NOT any of the posts about CONSULTING A QUALIFIED ATTORNEY!!!!

Alright, I can accept your "stop calling each other names and just agree to disagree in a diplomatic manner" suggestion. Duly noted.

However, stop using religious, fictonal characters in your post as justification. Being an athiest, your use of Mary Magdalene and Jesus as examples is akin to me using Captian Kirk and Spock as factual counter examples for you as a believer. Please don't assume everyone believes in fictional characters as canon or factal history.

As Spock famously says in Star Trek III: the good of the many outweighs the good of the few, or the one.

However, stop using religious, fictonal characters in your post as justification.

You're using a fictional character yourself Lancelot. An immoral fictional character at that. He stole Guinevere from his best friend and benefactor, King Arthur, right? I wonder how old Guinevere was, maybe 16?

Being an athiest, your use of Mary Magdalene and Jesus as examples is akin to me using Captian Kirk and Spock as factual counter examples for you as a believer. Please don't assume everyone believes in fictional characters as canon or factal history.

Hey, where is freedom of religion here? You're an aethist, I'm a believer. If I want to use my biblical characters, I am within my rights. I'm okay with your use of the knight, Capt. Kirk and Mr. Spock, so you should be okay with my Jesus & Mary Magdalene.

Please don't assume everyone believes in fictional characters as canon or factal history.

I never assumed that everyone believes in Jesus and Mary, you assumed it, as always. But anyway, since I'm a believer, I do believe in their existence. Not that I want to convince you.

Somehow I cannot reconcile that a moralist is an aethist

Peace be with you! I really mean that.
