I came on a K1 visa to the US almost 3 months back. However, as soon as I came, me and my fiancee decided to not go through with our marriage. During our fights, I had moved to a friend's house and there I met a wonderful man and now we are planning to get married.

But, many people are telling me I have to go back to Manila to restart my fiance visa applcaiton on my new fiance's name. However, we really do not want to be apart and my fiance does not have the time to go to Manila with me for now. I know many people here do not like people like me who only want to immigrate but I can assure you I am not like that.

Please help me by giving me advice as to what is the possible way I can stay here with my new fiance. We are ready to get married immediately. But if required, we can wait if there is some other way. I will be contacting some immigration lawyer but not all lawyers are that good and we don't know whom to trust so I thought to ask here. Please help by letting us know of any method so that I do not need to go to Philippines right away.

You get no sympathies from me. Women like you are exactly why the USCIS and the Consulates have to be so critical and scrutinize everything with this process.

You are free to marry anyone you want. You can marry the new guy but you can't stay here after the marriage. You still have to go back. There is NO way you can stay here legally on the K-1 visa you obtained through the previous guy. NO WAY WHATSOEVER!

No matter how you slice it--or how your lawyer slices it--you need to go back and go through this process again. And it won't look good for you. You're going to have to sincerely prove that this new relationship is sincere and that you won't just breakup and find another guy yet again.

That is true the K1 is only for you and your original petitioner.

Your new fiance wont have to travel to Manila, just gather evidence that you and him together, like dated pictures, credit receipts, copies of your air line tickets from you coming here... things that show you and your new fiance have met here in the USA.

But you will have to return to the Philippines and wait out the process of the newer K1.

Here me out, this would be something the D.O. would question you when you file for your AOS or make the next move to stay in the US: I don't know what to say, but with in 3 months (almost) you have decided to end your long love with a USC who applied and brought you here on a K-1 to be married with him (RED FLAG), have you married your "original" K-1 petitioner yet? If not, you should do ASAP since your K-1 visa status is only good if you marry him within 90 days, otherwise you will be out of status and a ban may be triggered upon this "misused" of your K-1 Visa.

You "District Officer" (D.O.) may also question the validity of your NEW found love and marriage. I am not so sure you have enough evidence to convince the USCIS that you truely in love with the new lover enough within the 3 months you were here on a K-1 Visa filed by another guy, enough to get married, if not to get married for the sake of staying in the US.

Find a GOOD lawyer or go back to the Philipines and start thing right all over. Make sure you don't tell the USCIS something like you said here "my fiance does not have the time to go to Manila with me for now". What fiance? You already have one, the one who brought you. Why doesn't he have time for the love of his life, who he is about to get married?

This is very confusing and I am not sure I can help you much more. Just hope things work out for you, LEGALLY!

hot diggity ! well im not one to be judgemental but damn! how can you be in US 3 months, split from the guy you got the k-1 through and already be so in love with another man and ready to marry?! I think the marry immediate plan is just to avoid going back since 3 months equals umm ...90 days! yep times up. gotta think quick. Sir lance is right you cant stay marry this guy while being on a fiance visa with another guy and then reapply for I-130 while staying in US. Impossible and dam right unbelievable! I'm sorry to seem so doubtful or negative but this is exactly why USCIS has everyone under a magnifying glass

I understand that sometimes, the picture turns different when the honeymoon is over...am not in a position to pass judgement on you. Just wondering if there is no more salvaging the relationship.

As to the question of your new boyfriend, it is not necessary for him to go to Manila, unless he plans to marry you in Manila...but you need to go back to Manila. The fiance visa was issued based on the facts presented by the petitioner, your fiance.

If your new boyfriend wants to marry you, he will have 2 options: petition for you from the USA, or go to Manila with you and marry you in Manila.

I won't judge your decisions but USCIS will! You need to do things the right way, and possibly you need to slow down to form a strong relationship and evidence of that.

Every one of us on this website is part of a long distance love. We all know how hard it is. Your actions will not get you much sympathy on this forum - sorry.

:yes: i'm about to get the red tape and flags myself on this one. there have been posts here before that have riddled me but this is a gut wrenching. Im not trying to deny anyone love but this ####### happens to often with people like that and its taking advantage of my country while i sit in a foreign country waiting for my own rights to be recognized ( ok maybe im a bit riled up..i'll breath in a moment) so that i can bring my fiance home after 3 years!

No one in their right mind would think the majority of the members on this website would come to her defenses and aid her quest to seek a new guy to marry after less than 90 days upon her entry to the US on a K-1 visa.

Lots of judgment going on here; ease up, she's trying to learn her legal options, and while fraud makes the process longer for all of us (in a hand of God sort of way -- if your divorce wasn't recognized, or I forget to sign something, it isn't the fault of a Filipina whose engagement failed), this isn't fraud.

It's not taking advantage of the country if everything is still within the legal time limit; this is rather like me getting upset, at this point, because someone met someone quickly and fell and love and it took me three years to get engaged.

Unfortunately, the original petition made by your now ex-fiancé is a petition to bring you here to marry him, not a general petition to get married in the U.S. To do this legally, you will have to leave the country and file new paperwork.

What kind of paperwork you file is dependent on what you do. Probably your best option is to leave, file a K-1, and come back again. You might also be able to get married, leave, and file a K-3. Either way, though, you're going to have to leave, and you need to. It sucks, I know, but you don't want to get out of status and incur a ban.

im not incinuating that its anyone's fault about my own case but come on! how high the bull have to pile before it starts to stink? ok maybe she did meet someone new but apparently as she said if she left the fiance 3 months ago her time is already up. its to obvious why she is in hurry to marry now. just so happens she comes to US, splits from fiance, has a friend there to move in with already and then wants to get married just as 90 days are finishing??? :no: no sucker stamp on this forhead...sorry
