Affidavit of support question: k-1 beneficiary may already have a job in the US

Hi everyone,

My South African fiance will be opening up a US office for the South African company he works for once he gets approved for the k-1 visa and moves to me in the US. Does this in any way affect our affidavit of support? I am guessing that it helps since he will be able to earn an income as soon as possible. Any info or help on this would be appreciated. What kind of process and/or documentation are we looking at?

Just keep in mind that a k1 needs an EAD to work, so just make sure you say that my fiance has a job lined up for him pending work authorization. :) Best advice would be to marry right away after POE and then file for AOS, and EAD should come in 2-3 months.

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

Beneficiary's income does not count for YOUR I-134. He cannot work in the US until he has an EAD or green card which will come 2-4 months after you file for AOS, after you are married.

The consulate CAN consider his future employability if they choose, they usually choose not to.

I do remember during my K1 interview that the CO said that my career would be very employable in the US, and he told my hubby that he was lucky (I am a speech pathologist) But apart from that comment, I don't think it mattered. He still needed to fulfill the I-134 requirements on his own
