Is authhorization letter from ex husband needed?

Hi ,

First just wanna say thank you all VJ's ,this site really helps a lot :)

I am divorce for almost 5 years and i have a 13 yr.old daughter from my ex husband . We just got our NOA2, now preparing for the next step. My question is do i need an authorization letter from my ex husband for my daughter to join with me K2. We have no communication since then and i raised my child with out him in the picture .Any inputs is gladly appreciated,thanks you so much :)

Our Love Journey

1992 = First time we met in the Philippines

2008 = Got connected again thru FS

March 2009 = Saw each other again after 17 yrs. (Philippines) (Two old friends meet again ,wearin' older faces talk about the places they've been... sing )

September 2009 = Engaged / Proposed in person (Philippines)

USCIS

Nov 30, 2010 = Sent I-129F

Dec 02, 2011 = USCIS received

Dec 06, 2011 = NOA

Dec 09,2011 = Touched

May 06, 2011 =NOA2

DOS

May 16 = NVC rceived

May 17 = NVC left

May 20 = USEM received (tracked thru DHL)

May 24 = Jap PC applied ( 7 weeks )

June 1 = Case entered to USEM system

June 21-23 = SLMEC/Passed

July 8 = Interview / Approved

July 13 = Jap PC picked up / sent to USEM (07/15 = Jap PC delivered to USEM) ( 07/29 = Visa printed )

If he is listed as the Father on the Birth Certificate, yes you need that. I believe there is another document you can obtain if you do not know his whereabouts. Go to your regional forum for better information about how to do this in the Phils.

And email the Embassy and ask them;;they are nice people and know what they want to see in this regard.

The answer is country specific. The Philippines is unique in many ways regarding this. First, please clarify the circumstances, as there is no divorce in the Philippines. Were you married to the child's father when the daughter was born? Do you have full custody?

@pushbrk thanks for the time ,yes there is no divorce in the Pihilippines ,i got divorce in Japan and i filed petition of recognition of divorce in the court here in Phiippines which was granted so i have no problem in that thing.Yes i was married when i have my child and i have the full custody since we divorce .

Solution:

I say that both parents whom names are on the paperwork should get a court decree allowing the child to leave the country.

This opens up the possibility of children being kidnapped from a parent and taken to another country............

yes true and i know someone who did that.. B-)

she didnt ask her husband's permission... but really she was surprised too that the CO didnt ask for a consent from the father... no DSWS paper works.. and even the annulled women i know tho they are the respondent CO didnt ask for a consent....

and now the mother and her 3 kids are in USA, enjoying life... :yes:

maybe it's a way of leveling the playing field, considering remarks you made in the past about being a man's world in the Philippines. I will not dignify them by qouting.

Essentially, yes.

Now, what needs to be clarified for the OP is whether the full custody is sufficient for visa issue and child travel. For China it would be. For many other countries it would not be. Is it for the Philippines? Opinions about what "should be" are not helpful in establishing what "is".
