I am trying to clarify contradictory items on my wifes I-864. Line 21 asks for the number of immigrants I am sponsoring based upon the total entered on line 10. That would be 1. THEN, on line 21c, I am directed to enter "1"

for my spouse if we are currently married. That, also, is "1". In so doing, she is being counted twice. I have looked at examples here on this site and the example given implies that the spouse was listed on line 21 as the immigrant in question and then on line 21c a "0" was entered even though-based upon info on the form- they were married at the time of the application. So, by entereing "0", the filer entered false data.

HELP! please.

Persons NOT sponsored in this affidavit. You are sponsoring your spouse so put '0'.

In the event you have a co-sponsor, in our case my father is law is a co-sponsor. He is married but she is NOT applying for AOS/the one being sponsored then you enter '1' as they are part of their household size.

This is how my husband and I have come to understand this.

It says not to count anyone twice. For the purposes of the affidavit she is the immigrant, not your wife.

K-1 is a non immigrant visa, and certainty not the petitioners wife if a K-1

OP, no timelines but, your stats show you filed K-1 If so you have no wife and the I-864 will not apply. What’s the right filing status?

OP, no timelines but, your stats show you filed K-1 If so you have no wife and the I-864 will not apply. What’s the right filing status?

The OP has FINISHED the K1. He specifically mentioned his wife, he mentioned the I-864 which is used for AOS and he posted in the AOS forum. While he doesn't have a timeline, you need only go to his profile and click on the "topics" tab and you'll see a previous post from the OP reading:

My fiance arrived in the US in Feb/2011 and her visa expires in May/2011. We were married the day after she arrived here.Does this mean that we need to file for the AOS before the expiration date on her K-1 visa or is there an intermediate step we can utilize as we gather the required funds to apply for the AOS?

Sometimes you need to take the OP at face value. He said wife. He said I-864 and he posted in the AOS forum, obviously he's AOSing and just hasn't updated his timeline. His profile can't be updated yet from K1 because he hasn't SENT his AOS so he can't put AOS (pending).
