Is it possible to process the name change on a SS Card from maiden name to married name while waiting for either the EAD or GC to arrive?

Since her AOS/EAD biometrics appointment is later this week and I'm taking off from work early to take her to that appointment anyway, I was thinking of killing two birds with one stone (and trying to avoid taking yet another day off of work) since the SSA office is fairly close to the USCIS local office. Of course, I don't want to waste our time if they're just going to say "No."

Does anyone know the policy on this?

Unless you have evidence of employment authorization, you cannot be issued a SSN card, however you can get the name on the SSN record updated if you can provide evidence of the name change.

RM 10211.605A Correcting Numident data when a replacement card cannot be issued:

Although the Field Office cannot issue a replacement card, you may correct the Numident (SSN record) if the alien provides documentation supporting the change, for example, a name change.

If the alien provides documentation supporting the change, process the replacement card application to update the Numident information but suppress the issuance of a card.

Provide written notice, using Form SSA-L676, to explain that we cannot issue a replacement card because the applicant did not present appropriate authorization permitting him or her to work in the U.S. and has not provided evidence of a valid nonwork reason for an SSN.

RM 10211.605 Request for a Replacement SSN Card Obtained for a Nonwork Purpose:

Thanks...

So, what I am reading is that she can update her info with the SSA but she can't be issued a new card at this time without EAD or GC in hand. Is this correct?

Would it be available at the Field Office immediately upon receipt/presentation of either GC or EAD? Do they issue corrected cards (with proper authorization) in the Field Offices on the same day? Or, is it only sent by mail?

The only reason it really matters is, unless there is some benefit (time-wise) to updating her info before receiving her EAD or GC, there isn't much reason to make a separate visit to the SSA offices just for that. I'd rather spend the rest of my 1/2 day off doing something else. yes.gif

Yes, you are correct, no EAD or GC, no new SSN card.

SSN cards are all issued from SSA headquarters in Woodlawn, MD, not the local office. Plus no card will be issued until the EAD or GC status is verified by SSA. This can happen while you are in the offices, or could take another week or even in some cases a couple months.

The SSN record being updated can be helpful in filing Federal income taxes, since the name you use on the return is matched against the SSN record. States also match driver's license application info against the SSN record.

The other small benefit is that once you have the EAD or GC, you are just applying for a replacement card, since the SSN record is already corrected.

:thumbs::thumbs: ..I would also agree...I was able to change my name on my SSN card when I got my EAD...after we applied for a change of name on my card, I got my new SSN card after a week...God bless...
