Hi guys... My mother married a permanent resident of america. They got married 1999. I was 17 years old that time. My mom went to states with my minor sister. I was left here because i want to finish my studies here in the philipppines. My step dad file a I-130 petition for me last 2008. Last april they received a letter from the USCIS requesting an additional documents (RFE), they sent the needed documents and USCIS received it last Apr29,2011. My case status online changed into Request for Evidence Response Review.

They give us 60 days waiting period for the approval.

My question is how long would it take before we received the result? does it takes 60 days or more? please help.

Is this a petition that should have been filed? U were over 21 when the step parent filed the petition for you.

Your step dad is till an LPR? and you were over 21 when the petition was filed? and you are unmarried? If all the answers are yes you fall into the F2B category. They are currently processing petitions that have a priority date of March 2000. Not sure why you got an RFE out of the blue but looks like you still have about 8 years to wait before a visa number becomes available.

Unable to say when the file would be adjudicated... It becomes complex since u were 25... There'a no true benefit and so your mother should be the one who is doing this for u.

I see... Somesays that since I was only 17 when they got married, my step dad can still file the petition for fast approval. is that true? When they said that "You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use the processing time information on our website to estimate when this case will be done. " ... are we going to receive a response from them? This was written on the case status on line..

I appreciate your answering my questions..

LPR? I'm sorry I'm not familiar with the acronyms.. May step dad is a permanent resident of US. I was only 17 when my mom got married to him. They said that my step dad can file the petition for me to get a fast result. I am over 21 and unmarried. USCIS send us an RFE asking for the death certificate of my dad. Do you think it will be approved this year? On my status online, they gave us 60 days waiting period to get a result from the USCIS.

Your dad could file the petition since he married prior to you reaching 18. Now that he has moved on I am not sure what happens, if someone else has to take responsibility, etc. If he had filed for you along with your mother and sibling you possibly could have come fairly quickly. Since he applied after you turned 21 you must wait for a visa number to become available.

Hang on! You said in THIS thread that your dad was a US citizen. Which is it?

for the step child to receive immigration benefit shouldnt the step parent file the petition prior to the "child's" 21st birthday?

Yap my dad is a US citizen....

I just called my mom and she said that my petition is like a fiancee case... Is there a possibility that there is a similar petition for that?

there's no petition that's like the K visa..
