Hello again everyone. Is it really necessary that the petitioner should file I-130 on my behalf before applying/to apply for AOS? Or is it okay to apply for AOS right away after marriage without filing I-130 at all?

Another thing is that if an advance parole can help me go back to the US anytime after I leave the US while AOS is pending? Does it has some certain days/months of validity?

I'm a lil bit confused and just need some clarification from 'experts' regarding these matter.

Some of you may think that I asked these too early for now but I just want to be proactive and always prepared for the future since I am going through this process. Your answers would be a great help. Thank you. :)

Dec. 08, 2010: Interview(DNA was recommended)

April 04, 2011: CRBA and US passport on hand

April 2011: SSN Application sent (mailed original docs thru 2GO)

My K1 Visa Journey

March 05, 2011: I-129F packet sent

March 14, 2011: NOA1

May 20, 2011: NOA2(approved in 67 days from NOA1, with no RFEs)

June 24, 2011: NVC received approved petition from USCIS

June 29, 2011: Approved original petition left NVC to US Embassy-Manila

July 15, 2011: Eligibility letter received from US Embassy-Manila(dated July 11, 2011)

October 26 - June 5, 2012: SLEC trap!!! (DOT tx to vaccine administration)

June 7, 2012: Interview (APPROVED!) :)

June 18, 2012: Visa picked up at the embassy

June 20, 2012: POE in Detroit

Don't file for I-130 :)

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

1. No. You arrive on a K1 and marry in 90 days then you're fine UNLESS you wait to file AOS more than 2 years after marriage then an I-130 would be good.

2. No I-130

3. Yes. Be aware though that you MAY have an interview and will either need to reschedule or be back in time for the interview. Depending on the period of time it could be quite expensive to buy a flight or change your flight short notice. Which is why it's best to wait if you can.

4. No. Once your GC is approved though you can't use it anymore. Well apparently you can use it to re-enter if your GC was approved while you were out but then that would be it.
