Hey everybody,

I am a US citizen due to marry my girlfriend (Brazilian citizen) coming up in June and we are just trying to get everything together so we can get this submitted after the ceremony.

My main question is which forms are we required to submit in order for her to receive her green card?

She currently is here on a J1 visa that is set to expire in June. Are we required to only submit form I-130? Confused if we fall in the category of filing the I-485 or not. But in conjunction we are looking to file the G-325A, I-131(authorization to travel) and the I-765(employment authorization).

First, this is the wrong forum - you should post in the AOS from tourist, work and student visa forum :) You'll get more feedback there.

Second, yes to I-130 and I-485. You are filing the petition for alien relative and the application to register permanent residence or adjust status concurrently. The I-130 is filed by the US citizen, who is petitioning on behalf of their foreign spouse, and the foreign spouse fills the I-485 form. You need the G-325A for both (you have to fill out one, she has to fill it for both of the main forms), and EAD and AP which you already mentioned.

Read through the guide here on VJ on concurrent filing of I-130 and I-485, it will give you all the info you need!

Also, just to make sure you have not overlooked this - make sure her J1 visa does not have a 2 year home residence requirement. If it does, it will say so on her visa. If the 2 year HRR applies to her, it would mean that she is required to return to her home country for a period of two years when her authorized stay here expires, and you would need to file a waiver for that.

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

("Resident since" date on the GC is 07/20/2011

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Ok perfect.

Got all the forms filled out, checked and re checked them. Have all required paperwork to attach, now just waiting for our wedding date at the end of June.

One question though, when I send in all the forms can I just put everything in one envelope? Also should I staple all pages of each form together?
