Hi to all fellow users!

I was wondering if anyone can help me? I am from ireland.

I have been having the worst trouble with my application. My story is that we married in september 15 2010. In october we applied for cr1 visa. We never heard anything abck from USCIS. I kept pestering at my american husband and his reply was government holidays these things take time... Finally got him to call in february and we had page 2 of I-130 missing form packet. We had no notification of this from USCIS which was very strange.

We sent the missing page the very next day. I know our application was now to be pushed back so before my husbands trip in march he called again and we were told to reapply due to the length we had waited to see if that would push our application forward a bit.

It was finally sent in april and it has been a month since it was sent.

My husband has wrote to local senator in hope for some help... I have asked him to call again but we shall see when that will happen...

Can anyone enlighten me with this? Or help? I have had 2 1/2 years of waiting to get back and just want to be there like eeryone else

Thanks so much!

Wow, that is a bad break, sorry to hear about that. Was there any explanation from the USCIS as to why you never got a notification (RFE) about the missing page? Did you get an NOA1 when the package was sent in the first time? Has your husband gotten an NOA1 when he sent the package a second time?

In any event, getting a Senator involved after only one month isn't likely to help, unless you can show that the USCIS was negligent with the first petition.

Best of luck on your journey...it's probably not much consolaton, but at least you are back in the game now.

Wow...If my spouse was that stubborn I would have called or contacted USCIS myself.

I do not see how they could really let you jump the line. Waiting that long in between for a response is crazy. I bet they assumed that you were not planning on coming over and looked over the file.

I think you have done the right thing by contacting the local congress person. You have to wait for a response from them. Maybe you can try calling USCIS and speaking to someone higher than the operators and state your case as to what has happened.

You have to be proactive about these things, you can't wait for them to come to you. Remember, it's a government process your dealing with here.

Good Luck.

Just to clarify, your profile reads "DCF". Did you you file directly at the embassy in Dublin?

Mrs. O that was my error no we have applied in america to the chicago lock box :)

Dave and Kinnari trust me i have been trying to be very proactive and looking at all possible options. I have tried to help my husband understand this whole process. He said he is going to call this week if he doesn't i will be calling myself... He is also friends with a governer that is running for president and will be writing to him too...

magdasal as far as what my husband said he didn't get an explanation and i am going to go with what dave and kinnari said they probably figured we gave up since we didn't respond faster. No NOA1 for first time for application and no NOA1 for the second time we are still waiting...

Hopefully this call will explain a bit more this time around :)

Thanks to you all and good luck in your own journeys!!!

You haven't applied for anything. The US Citizen spouse filed a petition. When the petition is eventually approved, the foreign spouse will have the opportunity to apply for a visa. USCIS doesn't issue visas. The US State Department issues visas through Consular services abroad.

My husband never told me he was working on it and getting information today. So fingers crossed! And thanks for the help :)

And pushbrk I do know this. We are waiting on our NOA1. It is a small step forward to a long process that my husband and I are working to being together. And since we have had so much trouble trying to get this notification I was simply asking for help.

So since you have through this process is there anything you can suggest?

Start by properly stating what you think the problem is. Just how far did the petition get? For what reason did whom suggest you file again? What actually happened to the first petition?
