hi, does anyone know how long it takes for my son to get a visa if my husband who is a USC the one petitioning for him? i also wanna know how long it takes too if I (permaent resident) am the one petitoning? is there any difference with the processing time? which is FASTERr? because i have a 2 year old son and im confused if i should be the one petitioning him or my husband... i wanna know which is faster... PLEASE HELP!!! thank you...

Let your husband petition for him.. it can take 6--9 months if an expedite is approved. If YOU sponsor him it will take 2.5-4 years.. Regardless OF WHEN you arrive in teh USA.

Let your husband petition for him.. it can take 6--9 months if an expedite is approved. If YOU sponsor him it will take 2.5-4 years.. Regardless OF WHEN you arrive in teh USA.

Sure... you're welcome. IF the expedite is not granted THEN it will take 8-10 months for the case to be completed. I am UNABLE to say how long is the wait for an interview in the philipines once the case is completed at the NVC. I hope someone from that region will step forward and answer your question.

it sorta depends on what you want to do, or think you want to do.

and mostly, that's based on time, timeticks, timeline.

IF it's been less than 1 year from the time of K-1 visa approval back in the PI, HE can kickstart a K-2 (follow to join) visa app with the Embassy directly (must make phone calls, fax, and email about it to the Embassy)

or

IF it's been more than one year since the K-1 approval date, HE can file an I-130 to USCIS on the child.

You can file an I-130 if you wish, but, IMO, as a LPR, will take an inordinate amount of time on the process.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

I entered as k1 visa...i know i can bring my son using k2 visa but our finances are tight right now..that's why we're planning to file for I-130, that should be enough time to save up for our plane tickets.. :)

Hi there!

Just wanted to have a follow up question on the same issue however different scenario.

I entered here in USA as K1 visa holder and I have a 10 year old son in Manila. My USC husband and I decided not to include him to the petition due to financial issue plus my son is currently studying.

My question is: I wanted to wait for me to be a USC which is like 3 years from now, which is also good as my son will finish his elementary by that time in Manila. Will it be the same time line (6-9 months)? Or it will fall under a category which needed a priority number?

I've read the guidelines but I am not pretty sure which category will be my situation will fall.

Mary, if YOU are a USC then -

it's actually one of the two fastest categories (USC, foreign child under 18; compares in speed to USC petitioning foreign spouse via CR-1)
