I need an advise about my dilemma. My mom got married in the Philippines to a US citizen (2004). My sister (2006) and I (2007) were petitioned and migrated to US (LA) leaving my eldest brother behind who is over 21 at that time (he was petitioned). But my mom and her husband have a misunderstanding and we(mom+sis+me) decided to move to NYC (2007). Obviously, my mom's green card expired and didn't got the chance to renew her green card before their feud because her estranged husband hid her mails coming from the immigration regarding applications stuff. Now I believe her status is an illegal alien. My concern is that would this affect my sister and my application for citizenship? what about my brother's pending application? Also, is there an easy way to help my mom get a new green card? Thank you very much for the help!

So your mom saw the expiration date on her green card but didn't do anything about it? Was she on a conditional (2 yr) green card? How many years has she been out of status? Has your mom talked to an immigration attorney?

The hidden mail reason likely won't go too far. The expiration date is there on the GC.

Her green card expired 2008 and she didn't do anything about it because she was suffering from depression(call it stupidity,i know). She told me that they applied to renew her conditional visa (2007) and was returned due to insufficient fees. that mail was hidden because their feud was escalating (she didn't know till we got here in NYC. Now I'm the one who is researching about this matter (well, before consulting a lawyer because of financial issues.)

so she was out of status for about 3 years now.

Her GC is likely considered abandoned. Not sure if there is a path for her to remove conditions on her own. Is she divorced from the husband or separated.

This is definitely lawyer time where all the details/circumstances can be laid out and examined by a qualified person.

Not to mention that jerk hid my gc as well(2007)i applied for a new one (lost gc) mine will expire 2019 and May 5th 2012 is my 5th year residency. The reason why this issue was brought up because my uncle passed away last December (2010) and guess what? yes she cant go to our country because of her status. then she told us about her problem, now we know. (well, me and my sis are busy in school-nursing students at NYU (very intensive) and we don't have a free time to visit a lawyer at this moment.

not yet divorce. (though she is thinking about doing so this year)

How wonderful.... Don't let mom do anything to cause her to show up on USCIS radar until she consults with an attorney. The lapse of time between expiration and now is the issue.

Find a free spot in your schedule and take mom for a consult. I remember that my ex-wife had some free time in her BSN program. Make it her Mother's Day gift from the both of you. smile.gif
