USA police check needed ???

Timeline

Hi. I met my husband (australian) while he was working in the USA for three years. We currently live in Australia and filed our I130 DCF in Sydney. He's in the process of getting medical / police checks etc. done and I've heard that he's not required to get a police clearance done from the USA. Does anyone else filing DCF have any knowledge of this ?

Correct- the USCIS office inside the embassy will do its own police/ background checks for any time spent within the USA.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Our instructions from Riyadh embassy specifically excluded the time we lived in the US. I think they run their own over there.

Just thought I would add my response that I received from the Sydney Consulate today. The following is their exact reply.

"As per the information available in Packet 3 regarding police certificates, present and former residents of the United States should not obtain any police certificates covering their residence in the U.S."

Although Packet 3 does not specifically state the above- mine anyway.

This is an old thread but it came up in my search and is the question I am wondering about. My husband and I lived in the US together for 13 years. He held a valid green card. We now live abroad. Do we need to obtain only a police record from the country we currently live in? We lived in many states while in the US so I don't exactly know how we'd get all those reports. Thank you.

The information in this old thread is still accurate; you do not need to obtain a police certificate from the US, as they will do their own checks.

Your husband will likely need a certificate from the current country. If he has lived in other countries since turning 16, he might need to obtain additional certificates. Here are the cases in which he'll need to obtain one, from the State Department's NVC page:

IF you…have been living in your country of nationality at their current residence for more than 6 months

AND…you are 16 years old or olderIF you…lived in a different part of your country of nationality for more than 6 months

AND…you were 16 years or older at that timeIF you…lived in a different country for more than 12 months

AND…you were 16 years or older at that timeIF you…were arrested for any reason

AND…you were any age at the time of the arrest

(That page also contains a link to the reciprocity schedule per country, so you can look up how to get the certificate(s) needed.)
