Following-to-Join K-2 visa PROCESSING...HELP!!!!

My visa was issued on aug 27, 2010. I entered as K1 on nov.21 of last year and got married with my fiance within the 90 day period. i have a 2 year old son in the phils. We would like to bring my son over here. I declared my child on all the previous paperwork except at the time we didn't intend for him to travel with me. Now we would like for him to be with us. How would i get him here to come to the US and what are the things i should do and where should i start? can he still avail of the k2 visa? where do i send the k2 application documents? what are the steps? I NEED ADVICE... please help....... thank u so much!!!!

If I'm not mistaken you have one year from the date you were issued a visa to use the K-2 derivative. Now sounds like your child have not interview by embassy. if you have not include him in the interview process when you had

one then you have to pay the visa fee's and set an interview date. you might also need to do a medical for him. I'm not so sure about how exactly this work but asked the embassy about this issue.

I'm also going to a the same K-1/K-2 because my fiancee and I have a baby boy, and we want him to be with us. we will be paying his visa and medical so i think you have to do the same thing.....

do we still need to call the us embassy and set an appoinment for interview? do we still need to pay again the nonimmigrant visa fee which is $350 for my son(K2)???? please help me... i don't know what to do.... :(

Yes and yes. The exact process varies from one consulate to another, but basically consists of a new visa application with most of the same forms, fees, and medical exam requirements. The details of what needs to be submitted for each applicant should have been covered in your packet 4 instructions. The main thing that varies from one consulate to another is the actual process for making the interview appointment.

If your fiance is the biological father then your son isn't eligible for a K2 visa. He has a claim to US citizenship. You and your fiance need to file a CRBA with the embassy and get your son a US passport.

yeah..he wasn't there when i got interviewed at the embassy because i have no intentions to bring him with with me at that time..my plan was for him to follow...my visa was issued on aug27,2010...so i should process his visa before that date this year and have him interviewed, right? ok so i have to pay the $350 visa fee for him, them set and interview schedule...and after that he will undergo the medical exam during the interview.. my problem is i can't find the packet that the US embassy sent me i think i accidentaly threw it but i have a copy of its content saved in my laptop but not the scanned copy..below this is the content of the packet..

This is in reference to your fiance(e) (K1/K3) visa case.

Your case is eligible to be scheduled for a visa interview. You may request an interview appointment date by calling the Visa Information Services at 1-909-101-7878 (from the Philippines) or 1-888-877-9888(from the United States). There is a fee for calling the Visa Information Services. You should compile all required documents and undergo the medical examination before your interview. It is important that you must have you complete documents; otherwise, your vise application will be refused or you may be asked to return for another appointment.

IMPORTANT INFORMATION:

Please read and follow all interview preparation instructions for fiance(e) K1/K3 visa applicants located on the Embassy's web site at http://manila.usembassy.gov/wwwh3238.html. The instructions contained at the web site will inform you of the required documentation and procedures to follow prior to the interview date. do they need to bring and show it during the medical exam and during the interview? because i lost that letter that came from the embassy, the one that has that content shown above. :( so stupid... :(

The instruction packet is posted on the US Embassy website:

Download it. You basically need to follow the same instructions you originally followed when you got your K1. Pay the visa fee, make the interview appointment, get the medical, etc.
