Hello everybody,

I'm from Brazil and my boyfriend is from the US. We are planning to marry in a about a year from now, I don't how long all the proccess takes and which type of visa is better and easier in our case.

Once we intend to be together next year I realized we better rush on the procedures. It's too hard to be apart and wait for this 'right moment' to apply. My tourist visa was denied last year, so everytime we need to meet, he has to come or I have to go somewhere else. ;(

I'm concerned about the fact that he doesn't work, he served on the Military of the US and since he left, he has a "allowance" from the Military and as he study full time he can't work. Is that a problem? What are the chances of the visa get denied?

Which one of the visas are easiest and more indicated in my case?

From everything I have read and the people I have met who are from Brazil, the interview process seems to be very fair and well organized. If you have a year before you intend to be together your choices are pretty open. Since you were denied the tourist visa, it could be beneficial for you guys to get married there and file a K3 or CR1. I can only speculate from what I have seen since November of last year. My fiance and I are hoping to receive our NOA2 very soon. Best of luck to you--be prepared for a long and very frustrating process.

My husband is former military and went to school f/t AND worked f/t. He had school from 6am to 1.30pm and work from 2 till 10-11pm. So your fiance CAN work, he just needs to find a flexible job.

Anyway he can get a co-sponsor if he can't get a job but just saying he CAN work, he's just choosing not to.

I'm still confused about the differences between the K3 and CR1. Should we marry and start the proccess now? Is it easier if we start there (US) or in Brazil, which one would be faster? What about his financial situation? Is always required a interview? In case he cant be in Brazil for the interview and I have to go by myself, is a negative point?

Actually his schedule is kind of crazy and changes a lot, he has chosen that so he can finish earlier. Last month, for example he had classes from 8am to 12am and from 4pm to 8pm (in the same day) and now he's studying from 12am to 4pm twice a week and 4pm to 8pm 3X a week. That's why I say he can't work. ;/ The most important reason we decided to wait until he graduate (next year) and get a job to marry and apply for the visa.

Thank you very much... It was very useful. I'm sure he is the one, and cant wait to be with him. If I didn't have the tourism visa denied I'd try the student visa and at least we could have a normal relationship,i spend more time together and then come back and marry in Brazil, but my name is in the 'black list' already.

My doubt is if the proccess takes almost a year, we should marry now and apply for the visa, so in a year we'd be together. It's faster if he applies in the US intead of in Brazil?
