Hi,

I was wondering if anyone has experience with working out of the country (US) while on the conditional green card. Is that allowed? Is there a maximum amount of time you are allowed to be physically out of the country? Does it matter if you are out of the country professionally based on an assignment from your US based employer?

Any help would be greatly appreciated!

Thank you very much.

Jane

You can be out of the country for up to 1 year before you need to apply for a re-entry permit...

Please remember that any time you spend outside the US may effect the date you can file for citizenship.....

Hope this helps

Another question, is this any continuous one year period or a total length of time of one year for being out of the US? Also, will this affect my availability to remove the conditional status after two years and become a "permanent resident"? :help:

Thanks so much your input!

Yes it applys to all greencards

To remove conditions you will have to show evedence of your continued joint living in the USA, you will have to maintain your home in the states... also file US taxes together...

Read this

Maintaining Permanent Residence

Maintaining Permanent Residence You may lose your permanent residence status if you commit an act that makes you removable from the United States under the law in section 237 of the Immigration and Nationality Act. If you commit such an act, you may be brought before the immigration courts to determine your right to remain a Permanent Resident.

You may be found to have abandoned your permanent resident status if you:

* Move to another country intending to live there permanently.

* Remain outside of the US for more than one year without obtaining a reentry permit or returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.

* Remain outside of the US for more than two years after issuance of a reentry permit without obtaining a returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.

* Fail to file income tax returns while living outside of the US for any period.

* Declare yourself a “nonimmigrant” on your tax returns.

Go here and you will find a good explination of what you are required to do as a greencard holder.
