Hi Everyone,

Just got married and about to file for adjustment of status. My problem is I lost my current passport. I have my expired passport which has my tourist (B1/B2) visa in it and I have my I-94. I have overstayed for 10 months so I am scared to apply for a new one at the consulate. Will I be able to file without a current passport? I hope someone has had this experience. Also we have a co-sponsor because my husband doesn't earn enough but my husband owes on his taxes. Will I be able to file since he is behind on his taxes?

08/26/2011: Received Biometrics Appt. Notice

11/07/2011: At 6:00 p.m. status changed to CARD PRODUCTION ORDERED :-)

What is your country of citizenship?

I'm asking, because some consulates, mostly those who do not allow dual citizenship, will not accept an application for a new passport if you don't show them a Green Card.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. As JustBob mentioned, I had a hard-time to get a new passport from my German embassy. Like he said, countries don't like to or just plain don't approve dual citizenship and one way for them to have proof that you are not a US Citizen is by showing a green card.

I was fortunate though to get my passport after I had my NOA1 in the mail.

But to get back to your question - due to some circumstances I did not have a valid passport at time of filing for AOS and only had copies from my initial passport/visa that was lost and that was accepted. Even when I applied for a replacement I-94 due to the original being in the lost passport but no copy if it worked fine. The IO at the interview only verified that the old one was lost.

So get your filing started, if and that's if they do would want to see a copy of a current passport you could take this RFE To your embassy and request an express passport, temporary passport and should have no problem getting it approved.

12/23/2010 - EAD Approved and Card on its way - Email notification received *yay*

01/03/2011 - WOOOHOOO ...EAD Card in Hand!

01/04/2011 - Oh boy....Received Interview Letter today - February 3rd is the day! :)

02/03/2011 - Interview scheduled 12:45 p.m. - out of there before 1:30 p.m. - further review

Coming home, checking for touches at 5:30 p.m. - CARD PRODUCTION ORDERED !!!!

02/09/2011 - Yup another e-mail saying that my card production was ordered.

02/10/2011 - E-mail notification "Approval letter was sent today"

02/14/2011 - Welcome Letter / Approval NOA and Card (separate envelope) received!!! :D

Late November 2012 (have to look up my receipts ;) - mailed in ROC I-751

12/12/2012 - NOA 1, status extension received

12/18/2012 - Biometrics appointment letter received

01/08/2013 - Biometrics done

Thank you so much Maxximus. You really eased my worries. Can you tell me what you did when you went for your medical. Did they not need to see your current passport as identification?
