I have a question about when it comes time to filling out my affidavit... if I am still a student in College and I have not filed any taxes due to the fact that I havent had a job until this past December do you think I can get denied even though my grandpa is willing to help me and be my sponsor for my husband?

You can have 0 income and still sponsor someone. Now, your co-sponsor (Grandpa) must make enough to clear that I-864p (Poverty Guidelines). If he has enough to clear than that then no problem.

Now, my next question where are you living? This will come into play if you are living in Grandpa's house and he is head of household...it changes a bit there in terms of which form to fill out.

I have income right now..I am a waitress and I also have some money saved in the bank still... and my grandpa owns his own bar and an apartment building along with a house that he rents out... and I live with my parents still.. my grandpa lives on his own so he is only taking care of himself.

Alright. I'm not 100% sure on this, but they will ask why you have not been filing your taxes. You will have to show them why you have not been. You might even be asked to provide a copy of your assets (bank account, property, stocks etc.)

Grandpa as your co-sponsor I believe will have to fill out another i-864 not i-864a as he is not a household member. He would select the option "I am the only joint sponsor"

Oh ok, I will be able to provide all of assets part but do you think I will have to show them that I have been going to school?? Like should I contact my university and maybe get something from them saying that ive been a full time student for the past 2 years?

When he fills out that form he has to have all of his taxes from the past 3 years printed out in order to send everything in right?

Yes you can have your University/College send an official transcript or just a statement from your academic advisor on University/College letterhead if you want. Make sure it has the dates that you have been attending there.

If it were me and you are not filing taxes. I would just state that I am a full time student and send in the transcript/school statement along with your I-864.

Personally, I am a nursing student in college as well. I did not make enough and my father is my joint sponsor. Being proactive just in case NVC asks why did I not make enough, I have already spoken to my academic advisor for this type of letter.

and Yes, Grandpa has to have all 3 years tax forms printed/xeroxed along with his I-864.
