Hi Everyone,

I'm really hoping someone could help us out with this question.

I'm a Canadian Citizen, I came into the USA on a Visitor's Visa NOT intending to get married or anything.

My now husband and I decided to get married because we did not want to do long distance anymore so it was spur of the moment thing.

I came in on November 14th, 2010 so my 6 month is coming up real fast here. We have already sent our package for AOS and it's still pending.

My question is do I need to extend my visitor's visa? or what do I need to do to avoid deportation etc??

You can wait in the US legally while your AOS is pending, until you have a decision on the GC application. If the application is denied, you will have to leave the US at that point (I think they give you 30 days, within which you have to leave or appeal the decision..). Bu until you have an official yes or no from USCIS, you are fine.

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

I would add that, although you probably already know this, you can not leave the US while waiting your AOS. Even as a Canadian, you won't be allowed back in and your AOS will be considered abandoned.

Now that your AOS is pending, you are in a NEW period of authorized stay, and your 6 months visitor allowance is void anyway. You are free to remain here until a decision has been reached on your AOS - in fact you must remain here until you have travel permission (Advance Parole) or you will abandon your AOS. So you need to do nothing but wait :) Good luck.

thanks everyone so much for such a quick response we have been calling around like crazy to make sure we're doing things right. Appreciate it!

we have sent in our application the 3rd time now so crossing our fingers we'll get NOA and go forward from there. Package was sent back to us due to our error in not checking our paperwork thoroughly so 3rd times the charm! :blush:
