Canadian visiting US wants to leave for Japan and then come back to the US

I have been looking high and low and can't find the answer to my question.

I am currently in the US visiting while we await our NOA2. I arrived March 26 and was planning on leaving June 29 to go back to Canada but my fiance just got sent to Japan to work and wants me to come there to visit for a couple of months. My passport was stamped B2 which, as I understand it, means I have 6 months in the US.

QUESTION: If I leave for 2 months does that still count as being in the US under the B2 or does the 2 months in Japan allow me 2 more months in the US? Trying to figure out when to book my return ticket to Canada so I don't overstay.

Any info, or links to sites with info for me would be very much appreciated. :luv:

Feb. 2/12: NOA - case transferred to California
Mar. 3/12: Biometrics Done!
Mar. 14/12: Work Permit card being printed (never arrived, lost in the mail)
May. 8/12: I-485 Approved - Green Card in the mail
May. 12/12: GREEN CARD!!!!!!!!!!!

Package Mailed then RFE then Interview... and finally:

Jan.21/15: 10 Year Green Card!!!!!!!!!!!!!!

Timeline

You are allowed to stay in US until the date that is stamped on your I-94 not on your visa.

You can go to Japan - at that point you will surrender your I-94 at airport when you leave.

When you want to enter back in US you will get a new I-94 and whatever date officer stamps on it, is what you get.

Canadians typically do not get an I94 so, in all honestly, this post doesn't apply

OP - did you have an I94 in your passport?

If not, you may leave before your 180 days are up. Obviosly any re-entry is up to the CBP but as long as you leave, you've met the terms of your admittance. You may reapply for entrance. If you leave the US, then you've left the US, whether you go to Canada, Japan, Mongolia, or New Zealand

On an unrelated topic how did you get the stamp on your visa so that you could visit for 6 months? I am Canadian as well, and my fiance is American. I know I am technically allowed to go and live there for 6 months but how did you go about doing it? Did you bring all of your things with you as well? Just curious :)

Correct we do not have an I-94 but when I went through customs at YVR they stamped my passport with a B2 and the date I left Canada.

I left with no ties to Canada (quit my job and moved all my stuff to mom's) - only a return ticket and all of our K1 paperwork showing we are going about things the legal way and a letter from my fiance saying he wanted me with him and would support me finanically. Had no problem at the POE, officer just asked the purpose of my visit (my answer to visit my fiance while we wait for our NOA2) he then asked how me met and what he did for work (told him and was honest) and he asked when we'd get married (my answer was when our K1 gets approved), he said have a nice trip - that was it. Didn't have to show any paperwork at all.

Frequently there is not stamp, occasionaly there is.

OP - any re-admittance into the US is up to the CBP.

Nope, no I-94 and not every time I've been to the US have I gotten a stamp, this time I did with B2 hand written on it.

Ticket to Japan booked - leaving the US May 16 back June 21 - can't see why they wouldn't let me back in since I have a return ticket from the US back to Canada for June 29.

Just hoping the VSC picks up the pace and we can get on with our lives together full time really soon!

Canadians have a situation unique to them. They do net need a visa to enter the US, but they are not a part of the VWP. They enter under a special Canadian Visitor Agreement where they do not need a visa, but enter under the terms of a B2 visa (6 months, sometimes even "Duration of Status," right to appeal etc). They never get an I-94.

They enter under a special Canadian Visitor Agreement where they do not need a visa, but enter under the terms of a B2 visa (6 months, sometimes even "Duration of Status," right to appeal etc). They never get an I-94.

Not NEVER, but occasionally. I've been issued an I-94 in the past
