K3 pending petition

Timeline

After applying for the K3 visa, can I move to the U.S while its pending or do I have to wait for the entire approval. In one section of the travel.state.gov it says after the visa process is complete and the visa is issued I can then move to the U.S

The other section says the foreign citizen can obtain a K3 and come to the U.S and wait for the approval of the visa petition.

Im confused, please can someone help me with this!!!

No you cant move to the US while its pending, you have to wait.

You can visit the US and your spouse while it is pending but you cannot move.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Timeline

The K3 visa used to be a quick way to the US while waiting on an I130 petition. But you must wiat until you have a valid visa in your passport before moving to the US as a resident. Almost all K3 petitions are closed by NVC because they are not faster than the I130

This will not be over quickly. You will not enjoy this.

K-3 is no longer the title of processing. Is now know as CR-1,

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

occurs at the US Embassy/Consulate that yer homed to, in Canada.

What's the status on yer application for a K-3 visa?

I-130 alone is for CR-1. I-130 followed by I-129F is for K3.

I-130 and I-129F petitions are tied together by USCIS and usually approved at the same time. Typically, the two approved petitions are sent to the NVC together and the NVC subsequently administratively closes the I-129F leaving only the I-130 for CR-1 active.

This is the correct description of what has been happening since February 1, 2010 with only two or three very recent exceptions. Since the K3 is no longer appreciably faster than the CR1 even in those exceptions, I still recommend following the CR1 path unless there's a compelling reason for wanting the K3. There is some indication USCIS may be changing their approved petition forwarding procedures to counteract NVC's new policy of administrative closure of I-129F petitions for spouse. It's too early to tell for certain and there has been no associated announcement.

With regard to "moving", if you show up at the border with household goods, you'll need to show a visa allowing you to live in the USA or be turned back. Visiting, is a separate matter.

We have filed the I-130 petition and understand that when we receive the receipt, my spouse of 9 years can apply for the I-129F petition and then once approved, we can then apply for the actual K-3 visa.

The time line given on-line is 4-6 weeks for each petition and unknown for the K-3 except that Calgary has an 8 day waiting period to book an interview and then I'm good to go to cross the border.

What gives? Am I to understand that this process is not right anymore?

Can someone give me an actual scenario where this process has happened for them and how long it took.

Why am I reading on this site that K-3 visa aren't used anymore? They are still available to apply for within the US sites. I'm confused.....

USCIS will approve the I-129F, 99.99 percent of the time the I-130 is bundled up with the I-129F and sent to NVC, who will then administratively close the I-129F, as the basis for a K-3 visa, an unapproved I-130, doesn't exist anymore.

You won't interview in Calgary. You'll interview in either Montreal for a Cr-1 visa or Vancouver for a K visa

This entire process takes about 8-10 months. Not sure where you got 4-6 weeks from nor interviewing in Calgary

PS - unlikely you'll go the K-3 path, follow the guides and directions for a Cr-1 visa, which is superior and WAY less hassle and less expensive
