I have a few questions on how to fill out this form --

I'm trying to petition for my wife but I lost my job and am unable to be the sponsor. My parents will be the sponsors instead; the both have jobs and an income so do they each fill out an I-864? Does one of them fill out an I-864 and one an I-864 A? Would they put themselves as joint sponsors or the only joint sponsor? Should I still include my own savings and assets?

So, I'm in the process of filing my 485. hit a snag with the affidavit of support. My wife is the citizen but she's currently not working. I have been in the states since 1996 and been working since. i do have an income.

There's a section in the instructions that says:

Are There Exceptions who needs this form?

. Any intending immigrant who has earned or can be credited with 40 qualifying quarters (credits ) of work in the United States

I just wanted to know if i can use this exception.

My question is following, im adjusting thru marriage and my wife (citizen), is my sponsor, now the problem is that her last year income, the most recent one, was only 17,000 and we have 3 ppl in our household, and as the poverty guidelines states it has to be at least 23,000. but there is a part in the instructions that says we can submit the 3 most recent taxes if you think that will help. now, her other 2 taxes are 35,000 , and 26,000 which are over the amount. would they get an average of all three of them, and which egual out to like 26,000 our you think i need another sponsor? thanks for the help.

This is by far the most retarded of the processes yet to date. What, are the people at the USCIS stupid? They LOST all of the forms that were submitted a few months ago?

ONE, an affidavit of support has already been filed (Which is STILL binding)to get my fiance here in the first place. Two, if you follow these directions for your WIFE then your total number in question 21 is not correct based on what the form tells you. Three, a form G-325 has ALSO already been submitted. Four, if you have had your medical done already to GET your fiance HERE you dont need an I-693 PERIOD. I HAVE yet to find a civil surgeon that will do anything other than make you go through a COMPLETE reevaluation and I have called 15 already. I am not paying $300 AGAIN plus the OBSCENE amount required for the AoS in the first place. If you read the form I-485 for the requirements they do not match all of the stuff visajourney lists that you should submut. So which is true? REALLY? You really think a cover letter, table of contents, etc is required? I am very thankful for the help this site provided me in getting my fiance and I through the process but I have to say the directions and information about this process are not only confusing and misleading but offer no explanation on WHY any of these forms must be done AGAIN.

Yes, I am a bit upset after all the hoops you have to jump through and all the money that is spent on this process I think I have a right to question the process.

I have tried calling the USCIS and can never get through to anyone to talk about this. That's frustrating as hell.

Hello All,

I reviewed I-864 topics but i have fairly easy question. My wife (USC) is my sponsor for I-864(I have H1-B). However; we did joint married tax return last year. So my question is, should we put only her income on I-864 for last year income(it is more than $19000) or since on tax return shows mine and my wife income should we use our total income.

July 3 - mailed out AOS packet

July 11 - NOA1 for I-485, I-131, I-765

July 13 - Biometreics appointment letter

July 25 - RFE I-485 - I-864 Form lacking evidence (most recent year tax return required, 1099, w-2, etc, and joint sponsor does not meet 125% mark)

I mailed out a I-864 for myself and one for my father since he is the joint sponsor. I have been a student and have no income and I am also listed as a dependent on his 1040 tax return. We also filled out I-864A Contract. Submitted my father's 2010 1040 tax return where it shows he has an income of that year for over $100,000. Yet in the RFE, it states that the joint sponsor's, being my father, income did not meet 125% of the federal poverty line for the joint sponsor's household size. I checked online through the government website and for our household size, his 2010 income was well above the 125% mark. They also asked in the RFE for the most recent year tax return, 1099s, W-2s, etc. but he is self employed and only has a 1040 tax return. Just recently he got his 2011 1040 tax return, so I am assuming they want to see this one instead of the 2010?

Will just mailing my father's 2011 1040 tax return, a letter stating that he is self employed and has his own business suffice in answering this RFE?

I need help for Form I-864, Affidavit of support. My USC wife is sponsoring...

Could you please check if following documents are sufficient for Form I-864?

i. Form I-864 filed by U.S. Spouse/Sponsor

ii. Copy of Sponsor’s Passport Biographical Page

iii. Copy of Sponsor’s Birth Certificate

iv. Copy of Sponsor’s Social Security Card (needed?)

v. Employment Verification letter for US Spouse

vi. Copies of 12 most recent earning statements issued to US Spouse

Do i need to send W2 in addition to IRS Transcripts:

vii. IRS Transcript for tax year 2011 and copy of W2 (?)

viii. IRS Transcript for tax year 2010 and and copy of W2 (?)

Hello everyone!!

We're on/working on getting the k-1 visa.

I need a little help, we're still waiting for our interview date but I've been looking at AOS for a while.

First off I don't have anyone who could co-sponsor, nor sponsor my husband to be.

I've got a job but I don't make enough money, I make about 5K under the limit and don't have 20K laying around.

The good thing is we do have some savings and the wonderful (hopefully) thing is he makes an income that will continue once hes in the US and once hes a resident. (1) Use of Intending Immigrant’s Income. If the sponsor does not meet the

income requirement on the basis of his or her own income and/or assets,

the sponsor may also count the intending immigrant’s income if (1)(a) the

intending immigrant is either the sponsor’s spouse or (b) has the same

principal residence as the sponsor, and (2) the preponderance of the

evidence shows that the intending immigrant’s income results from the

intending immigrant’s lawful employment in the United States or from

some other lawful source that will continue to be available to the

intending immigrant after he or she acquires permanent resident status.

The prospect of employment in the United States that has not yet actually

begun does not count toward meeting this requirement.

So my question is, how do we do this? How do we add his income to mine? We'll be fine if we can but I'm not sure how to?

I am due to fly out on the 10th of December and am getting married on the 14th. I fill be filling completing AOS shortly after and have a few questions about the I-864.

Question 18) It says SSN is required. Is this the case. Can I not put N/A?

Question 24) Do we fill out questions D & E?

Question 25) My Fiances 2011,2010 and 2009 tax forms will be below the poverty line. She graduated in May and started working full time then. Will this be ok?

What would happen if she hadn't filed Tax returns for those years?

Read the heading: Part 4. Information on the Sponsor. That's not you. It also says "Required".

Question 24) Do we fill out questions D & E?

If there is a person living in the house who is contributing income and has a current job or income in the US and they are named in 24b. You don't work in the US so 24b and 24e don't apply to you.

Question 25) My Fiances 2011,2010 and 2009 tax forms will be below the poverty line. She graduated in May and started working full time then. Will this be ok?

If she provides excellent proof of her current income and employment, they can accept it as enough.

What would happen if she hadn't filed Tax returns for those years?

She would have to file them now (late) or write an explanation of a valid reason why she did not have to file....zero income is one valid reason.

Hi,

I had some questions about the financial verification and requirements.

I am a student and have only been employed for the latter half of this past year (2012). My W-2 shows only $5,000 in earnings. I have no tax returns from the previous two years. I do have a long-term job, and I have recently accepted another job with which I can make approximately $1,600 per month combined.

I also have a car and my fiance has a car. The value of mine is $8,000 and his is $20,000. I have a bank account of savings of $15,000. He has a savings of $3,000.

We are completely on our own as far as a cosponsor. I understand that any assets we have must be 3x the deficit between the approximately $19,000 poverty line and that only one car will count. We can change the titles so that we both own both cars jointly.

I can get a letter from both of my employers stating that these are long-term jobs.

What are the chances that we will be approved without a cosigner? Are there any suggestions?
